- The Government is contemplating awarding a Purchase Order to Livermore Software Technology Corporation (LSTC), Livermore, CA, for LS Dyna software subscription Right to Use licenses, Right to Use support and software maintenance. ARDEC users of the LS Dyna code have increased, and are likely to continue to increase in order to meet current and future Army program analytical requirements. Livermore Software Technology Corporation (LSTC) is the sole developer, manufacturer, modifier, provider, and distributor of LS Dyna software. In addition, its source codes used to write the software programs are proprietary to the company and protected under copyright patent laws. Therefore, enhancing and/or upgrading the software can only be done by the developer for the same reason. FAR 6.302-1(b)(1)(ii), only one responsible source is applicable to this requirement; awarding this purchase order to any other source would create substantial cost duplication and unacceptable delays to the Government that is not expected to be recovered through competition. The procurement is for Software Right to Use Licenses, software support and maintenance for a Base Year and three Option Years, with the number of licenses increasing in the subsequent three Option Years.
