- NAICS Code: 334516 The U.S. Environmental Protection Agency, Region 5, Acquisition Section intends to negotiate on a sole source basis with Waters Corporation, 34 Maple St., Milford, MA 01757 under the authority of FAR 13.106-1(b) Only One Source Reasonably Available, to purchase the following Renewal Service Plans for the period ending December 31, 2007 and the following New Business Service Plans for the period ending November 30, 2008 for existing laboratory equipment and related software: A) Renewal Service Plans: Two (2) TAP 2690/2695 Sys, TAP 2996 PDA DET, MassLynx Software, TAP Quattro Micro (Mass Spec), MassLynx Software (Mass Spec), and TAP ZMD Mass Detector; and B) New Service Plans: Total Assurance Warranty Quattro Premier, Total Assurance Warranty ACQUITY Sample Manager, Total Assurance Warranty, ACQUITY Solvent Manager. Sole source determination is based on the requirement that support and service must be performed by personnel having in-depth knowledge of the instrumentation and technical support required in order not to limit the usefulness of the analytical systems of the laboratory. The above-identified service plans from Waters Corporation are the only known ones that can maintain existing equipment reliability. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by closing date will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
