Attachment 1 PERFORMANCE WORK STATEMENT (PWS) REFUSE COLLECTION AND DISPOSAL AND RECYCLING SERVICES C.1 GENERAL- The Contractor shall provide all labor, materials, supplies, equipment, transportation, permits and licenses and containers (except as provided as Government-furnished) necessary to collect and dispose of all refuse, and to collect and to recycle all recyclable items at U.S. Coast Guard Family Housing Facility, Novato, California and the U.S. Coast Guard Pacific Area Strike Team Hanger #2, Hamilton Field, Novato, California. The Contractor shall perform these services in accordance with the terms and conditions of this contract and in keeping with good business practices. C.2 DEFINITIONS- As used throughout this contract, the following terms shall have the meanings set forth below- C.2.1 "COLLECTION" means the accumulated refuse from any one pickup station at any one time, regardless of the number of containers, dumpsters, or other boxes, bundles or bags, etc. C.2.2 "DEBRIS" means grass cuttings, tree trimmings, stumps, street sweepings, construction waste and similar waste material. C.2.3 "DISPOSAL FACILITY" means locations authorized by Federal, State or Local Governments to receive and dispose of refuse. C.2.4 "GARBAGE" means kitchen waste resulting from the handling, preparation, cooking, and serving of foods C.2.5 "RECEPTACLES OR CONTAINERS" means cans, drums, bins, dumpsters, and multiple containers or similar receptacles that can be handled easily either physically or by mechanical truck mounted hoists. C.2.6 RECYCLABLES include any of the following listed items or combination of a. Corrugated cardboard that can be recycled. b. Bottles, glass or plastic c. Tin or aluminum cans d. Glass or plastic d. Magazines, paper bags, office paper, computer paper & newspapers. C.2.7 "REFUSE" includes all garbage, ashes, debris, rubbish and other similar waste material. Not included are explosive and incendiary waste, hazardous waste and contaminated waste from medical and radiological processes, or all material listed as hazardous waste in (Code of Federal Regulation) 40 CFR Chapter 1, Part 302.4, with the exception of those items that are conditionally exempt, as described in 4 CFR Chapter 1.261.4 (b) (1). Refuse collected at households shall not include rocks, earth, construction waste, heavy or large metal objects, such as refrigerators. Also not included are " recyclables" as defined in paragraph C.2.6. C.2.8 "REFUSE COLLECTION" means a system of transporting refuse, including non-accountable salvage, from pickup station(s) to the point(s) of disposal. It includes hauling garbage to the transfer station when required by the terms of a salvage contract. C.2.9 "RUBBISH" means a variety of non-soluble waste material, such as, but not limited to, metal, glass, crockery, floor sweepings, paper, wrappings, containers, cartons and similar articles not used in preparing or dispensing food. C.2.10 "PICKUP STATIONS" means designated locations where refuse may conveniently and efficiently be accumulated and stored in containers for collection. C.3 COMPLIANCE WITH LAWS AND REGULATIONS- The Contractor shall comply with all Federal, State and Local laws, ordinances, statutes and regulations pertaining to the collection, transportation, and disposal of refuse and recycling. The Contractor shall obtain, and make available for review by the Contracting Officer and the Contracting Officer's Technical Representative (COTR), all permits, licenses or other authorizations required by such laws. C.4 USE OF ALCOHOLIC BEVERAGES OR CONTROLLED SUBSTANCES- The use, possession or sale of alcoholic beverages or controlled substance by Contractor personnel while on duty is strictly prohibited. The Contractor shall immediately remove any employee who uses, possesses, or sells alcohol while on duty, or is found to be improperly in possession of a controlled substance. Removal of the employee for such causes does not relieve the Contractor of the requirement to provide sufficient personnel to adequately provide the services. C.5 VEHICLES- All refuse collection vehicles used by the Contractor in the performance of this contract shall be specifically designed for the purpose and be compatible with the bulk containers utilized. Bodies of packer type trucks utilized by the Contractor shall be leak proof and fully enclosed. Vehicles shall be maintained so as not to leak oil or other fluids. All equipment utilized to collect refuse shall be maintained in a clean, sanitary and safe operating condition as required by Federal, State and Local laws, ordinances, statutes and regulations, and to the satisfaction of the Contracting Officer and COTR. Vehicles shall have appropriate exhaust system and mufflers to minimize noise. C.6 POINT-OF-CONTACT DURING NORMAL BUSINESS HOURS- Upon award, the Contractor shall provide the Contracting Officer and COTR, a point-of-contact, facsimile number and a telephone number for the person(s) responsible for the day-to-day operations of this contract. C.7. CONTAINERS: The Contractor shall deliver, place, service and maintain Contractor-furnished containers as specified in the "Schedule of Supplies/Services and Prices/Costs." C.7.1. RELOCATION OF CONTAINERS- C.7.1.1 In the event the Government requires the relocation of Contractor-furnished refuse container(s) the contract will be modified by mutual agreement of parties. The COTR will notify the Contracting Officer in writing if a change is needed and the Contracting Officer will issue a modification to establish the new collection site locations. C.7.1.2 The relocation of containers will be scheduled to be performed in conjunction with the Contractors' regularly scheduled pickups and shall be at no charge to the Government. C.7.2 CONDITION OF CONTRACTOR-FURNISHED CONTAINERS- All Contractor-furnished containers, 3 cubic yards or larger, shall be standard commercial colors (natural tones are preferable) and stenciled with proper labeling as prescribed by local, state or company directives. C.7.2.1 All Contractor-furnished dry trash containers shall be rodent resistant and have secure latching covers. Containers shall be in good condition with all movable parts, lids, locks or latches, properly functioning, if applicable, and lids shall be free of cracks, holes, and jagged or sharp edges, and rust (if not made of plastic). C.7.2.2 All Contractor-furnished recyclable containers shall be light-weight plastic types. Containers shall be stenciled with the words "RECYCLE " in white with the recycle symbol also in white. Containers shall be in good condition with all movable parts, lids, locks or latches, properly functioning, if applicable, and shall be free of cracks, jagged or sharp edges. C.7.3 SANITATION- The Contractor shall ensure that all, Contractor-furnished containers, 3 cubic yards and larger, are cleaned as necessary, to insure they are free of insects, vermin, and foul odors. The interior and exterior surfaces of each container shall be maintained clean, and free of debris and odors, when they are placed on-site and after each time they are emptied. C.7.3.1 If the COTR notes the Contractor-furnished containers do not meet the sanitation standards set forth herein, the COTR will notify the Contractor via telephone (noting the time and date of the call) or via E-mail. The Contractor shall replace the container(s) within two (2) working days from receipt of notice. If the container(s) is not replaced timely, the COTR will issue a Contract Discrepancy Report (CDR) with recommended defect deductions and forward to the Contracting Officer for action. All notification documentation is subject to review by the Contracting Officer. Replacements shall be at no additional cost to the Government. C.8 MAINTENANCE AND REPLACEMENT OF CONTRACTOR-FURNISHED CONTAINERS: C.8.1 The Contractor shall inspect each container at least once a month. Inspections, maintenance and replacements should be performed during normal pickups. C.8.1.2 If the COTR notes the containers are damaged; missing lids or latching devices; have jagged lifting channels, holes or cracks and rusted-out bottoms or sides, and are deemed unsightly, the COTR will notify the Contractor via telephone or E-mail. The Contractor shall either perform maintenance or replace the containers within two (2) working days from receipt of notice, otherwise, the COTR will prepare a Contract Discrepancy Report (CDR) with recommended defect deductions. COTR shall annotate the date and time of the telephone call to the contractor and retain a copy of the E-mail (as applicable) in the COTR file. All notification documentation is subject to review by the Contracting Officer. Maintenance and replacement shall be at no additional cost to the Government. C.8.2 COLLECTION- C.8.2.1 The Contractor shall collect all refuse, improperly dumped refuse, loose refuse and recyclable materials (paper, glass, metals, plastics) from Contractor-furnished or USCG-furnished containers as described in this contract. C.8.2.2 The Contractor shall remove all loose refuse, such as- small boxes, bundled and tied newspapers and magazines, tied plastic trash bags, and other suitable containers placed with the USCG-furnished refuse containers on collection days. (Note- COTR will instruct tenants to flatten large quantities of cardboard and dispose of in 30-yard container located on Crescent Drive.) C.8.2.3 The Contractor shall return the emptied containers to their original position with the lids replaced and latched. C.8.2.4 During pick-up operations, containers shall be handled with care so that the containers are not damaged beyond normal wear and tear, and noise generated from such work shall be at an acceptable level . C.9 The Contractor shall be responsible for any damage incurred to USCG containers through careless handling in connection with this operation. C.9.1 The Contractor shall immediately clean up any refuse or recyclable items spilled (during the collection process) while emptying the contents of the containers at the pick-up stations or in route to the disposal facility. C.9.2 The Contractor shall not be responsible for the pickup of any household containers larger than the 32-gallons or greater. The Contractor shall notify the COTR of any oversized containers or containers with excessive amounts of weight. C.10 DISPOSAL AND RECYCLING- C.10.1 The Contractor shall dispose of all refuse, and recycle all recyclable items collected under this contract. C.10.2 The Contractor shall dispose of refuse and recyclable materials only at a City or State authorized disposal or recycling facilities. The Contractor shall not dispose of any refuse on U.S. Coast Guard property. C.10.3 The U.S. Coast Guard will not place construction waste, wood, metal and refuse exceeding 55 pounds per object in the Contractor-furnished 40 cubic yard industrial containers currently located at the tennis court parking lot. (Collection and disposal services will be ordered under the Indefinite Delivery-Indefinite Quantity (IDIQ) portion of the contract.) C.10.4 The U.S. Coast Guard housing tenants will place all recyclable cardboard in the Contractor-furnished 30 cubic yard container located at the tennis court parking lot. Tenants will breakdown and flatten all corrugated cardboard items and place into the 30 cubic yard cubic yard containers. (The Contractor shall collect the 30 cubic yard industrial container as ordered under the IDIQ portion of the contract) C.11 HOURS OF WORK- Hamilton Housing Site: The Contractor shall only be granted access to the pick-up stations designated under this contract between the hours of 8:00 AM and 4:00 PM, Monday through Saturday, INCLUDING Federal Holidays. Pacific Strike Team, Hangar #2: The Contractor shall only be granted access to the pick-up stations designated under this contract from 7:00 AM and 3:00 PM, Monday through Friday, EXCLUDING Federal Holidays. C.12 PICK-UP FREQUENCIES- The Contractor shall collect the refuse and recyclable items, for disposal or recycling, as appropriate, on the days stated, including Federal Holidays, as stated in the "Schedule of Supplies/Services and Prices/Costs." C.13 SPECIAL REQUIREMENTS- C.13.1 Improperly Dumped Refuse on Government Sites: Ordering the removal of refuse of an unknown origin (improperly dumped refuse on Government site) can only be ordered by the Contracting officer through the issuance of a Delivery order under the IDIQ portion of the contract. The Contracting Officer will negotiate the final fixed price after the COTR determines the actual cubic yards of the improperly dumped refuse. (See the "Schedule of Supplies/Services and Prices/Costs" for the fixed unit price per cubic yard.) Refuse shall be removed off-site within twenty-four (24) hours after agreement of both parties. C.13.1.1 The Contracting Officer will issue the Contractor a Delivery Order at least two (2) work days prior to the date, that INDUSTRIAL, RECYCLABLE, or GREEN-WASTE containers are required for the improperly dumped refuse. C.13.1.2 Pickup of improperly dumped refuse may be scheduled and performed in conjunction with the Contractors' regularly scheduled pickups, but not later than the date and time specified on the Delivery Order. C.13.2 Missed Pickups by Contractor- Upon the notification to the Contractor, by the COTR, of a missed household pickup, Contractor shall make every effort to complete the pickup the same day, but not later than the next working day at no cost to the Government. C.13.3 The Contracting Officer's Technical Representative (COTR) shall maintain, as a minimum, a record of all correspondence relating to performance under this contract, all IDIQ ordering notifications and Contract Discrepancy Reports (CDR). C.13.4 GOVERNMENT-FURNISHED PROPERTY/EQUIPMENT/SUPPLIES - The following Government-furnished items are provided- 15 Gallon recycle containers and 32 Gallon trash containers.
