- FA860407R7465 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. The Request for Quotation (RFQ) number is FA8604-06-R-7566. This solicitation and incorporated clauses/provisions are those in effect through Federal Acquisition Circular Fac 2005-13, Effective 28 Sep 2006 & Class Deviation 2005-o0001 and DFARS Current to Change Notice DCN 20061109 Edition. The solicitation incorporates by reference the following clauses: FAR 52.204-7, 52.212-1, 52.212-3, 52.212-4, 52.212-5, and DFARS 252.204-7004 - Alternate A, 252.212-7001, 252.227-7013, and 252.227-7014. The below clause is included in full text: AF 5352.201-9101 OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). This is a sole source requirement IAW FAR 6.302-1 to The Mathworks, Inc., Natick, MA is the only designer, developer, manufacturer, and supplier of the items in the attachment that meets the Government?s requirement. Please note if manufacturer requires a license agreement to be signed by government, the terms and conditions of that agreement are required to be in compliance with all Federal Laws, Statutes, and the Federal Acquisition Regulation. The Air Force Research Laboratow, Sensors Directorate identified an information technology requirement for software. Use of Mathworks Matlah is essential to our requirements, thereby precluding consideration of a product manufactured by another company. Estimate of $100,262.85 was calculated by using the Mathworks website and dealing with the government representative from the company. 11. This solicitation was researched and is only produced by Mathworks, INC. The anticipated cost to the government is expected to be fair and reasonable based on historical purchases and the prices established. The specific software is needed to ensure compatibility and interoperability with the existing equipment currently at the location and to meet the needs of our personnel. In addition, the use of this software is necessary to ensure compliance with the established Secretary of the Air Forces' requirement for standardization. 111.
