- Background: Small/new businesses are an integral component to the U.S. competitive marketplace. Antitrust laws strive to allow for competition. Advocacy seeks research to evaluate how the application of antitrust laws, mergers and/or court cases has affected small businesses and potential entrants in the past decade or so. One avenue of study could be creating a competition/concentration of industry model with mergers/antitrust court cases as dependent variable(s). Other avenues of study include creating an entrant or small business performance model with mergers/antitrust court cases as dependent variable(s) or modeling the impact of a specific antitrust case on small businesses. Note that the models will need to capture the “natural” evolutions of industries, such as controlling for technological changes and demand for goods and services. (Researchers will need to show their proficiency in creating econometric models and familiarity with the data presented in their proposals.) The proposals need to specify the data and models to be used for the scientific research sought. In addition to others, firm size data from the U.S. Census Bureau (http://www.sba.gov/advo/research/data.html), firm size data from the U.S. Bureau of Labor Statistics (http://www.bls.gov/bdm/home.htm) or information on publicly traded companies that track large publicly traded company characteristics or initial public offerings by industry are options. Information from the Department of Justice and Federal Trade Commission (FTC), such as FTC’s “Horizontal Merger Investigation Data, Fiscal Years 1996-2003” http://www.ftc.gov/opa/2004/02/horizmerger.htm could help guide proposals. The study could focus on the entire economy or a few select industries. If individual industries are to be studied, overall findings should be applicable to other portions of the economy. As a side note, the federal government is showing interest in refreshing antitrust laws. Legislation in 2002 created the “Antitrust Modernization Commission” (http://www.amc.gov/) to examine and solicit input into antitrust laws. Work groups and meetings are currently being held and a report from this group is expected in mid-2007.
