- NASA/DFRC has a requirement for a Laser System. NASA/DFRC intends to purchase this item from Kern Electronics & Lasers, Inc, of Wadena, Minnesota. The authority for other than full and open competition is 10 USC 2304(c)(1) "Only one responsible source and no other supplies or services will satisfy agency requirements?. Justification is based upon Kern?s unique and proprietary capabilities to provide a laser system and associated software that meets NASA?s stringent requirements for the fabrication of required precision parts and hardware used in flight research projects. Additionally, Kern?s Laser system is the only Laser System that offers a full gantry system with open table design, automatic height followers, automatic focusing assembly with proprietary software and special optics, 3D engraving capability, reverse engineering software, and computer generated software that is programmed from a cad station. Award to any other source would result in failure to meet the Agency's requirements. The Government intends to acquire these commercial services using FAR Part 12. Interested organizations may submit capabilities and specifications of their product in writing to the identified point of contact not later than 4:30 p.m. local time on Sep 26, 2006. Such capabilities/specifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer, which shall be considered by the agency. An Ombudsman has been appointed.
