- Under the following notwithstanding authority, the Department of State is awarding a ninety day extension to the period of performance for the contract referenced above. FAA sec. 498(j)(1) (22 USC s 2295b) (which is part of chapter 11) provides that chapter 11 funds ?may be used to provide assistance under this chapter notwithstanding any other provision of law.?[1] Section 498B(j)(1) is limited by its terms to Fiscal Year 1993 funds. However, Congress has extended this notwithstanding authority for every succeeding fiscal year, including FY2006. Contractor: MacFadden & Associates, Inc.
