- This is a combined synopsis/notice of intent to procure commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are not being requested and a written solicitation will not be issued. The solicitation number for this acquisition is NOI6089, Notice of Intent. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-12. The North American Industry Classification System Code (NAICS) for this acquisition is 339111 and the small business standard size is 500. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a small business set-aside. All responsible sources may submit an offer that will be considered by this agency. The National Institute of Allergy and Infectious Disease has a need to procure 262 customized high-density genechips on a sole source basis from the only known manufacturer Affymetrix. The National Institute of Allergy and Infectious Diseases study the mechanism of drug resistance, gene expression and regulation and parasite population diversity and evolution. These gene chips are a one-time-use-only consumable and will be consumed in experiments. The design and manufacturing process of these genechips is wholly patented and owned by Affymetrix. Delivery location is the National Institute of Allergy and Infectious Diseases, Rockville, Maryland 20852. This is a firm fixed-price contract and the FOB term is origin. The FAR provisions and clauses that apply to this acquisition: FAR 52.212-1, Instructions to Offerors, Commercial Items; FAR 52.212-3, Offeror Representations and Certifications-Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders, Commercial Items; FAR 52.225-1, Buy American Act-Supplies; FAR 52.204-7, Central Contractor Registration; and FAR 32.703-2, Availability of Funds, FAR 52.232-34, Payment by Electronic Funds Transfer-Other than Central Contractor Registration. In order to be considered for an award, an offeror must have completed the online electronic Representations and Certifications located at http://orca.bpn.gov/ in accordance with FAR 4.1201(a). By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR at www.ccr.gov/ prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation [Note: Lack of registration in the Central Contractor Registration will make an offeror ineligible for award.].
