Description
The National Institutes of Health (NIH), National Cancer Institute (NCI), Office of Technology Transfer (OTT), plans to procure on a sole source basis with Maynard and Associates, Inc. 8008 Inverness Ridge Road, Potomac, Maryland 20854 services for the: Review and Analysis of NCI?s Active License Agreements. This acquisition will be conducted under the procedures for acquiring commercial items authorized in FAR Part 12 under the authority to use simplified procedures for commercial requirements as provided in FAR 13. The North American Industry Classification Code is 541199 and the business size standard is $6.5M. This requirement is set aside for small businesses. Pursuant to the Federal Technology Transfer Act (FTTA), the NIH has a significant program in worldwide patenting and licensing inventions with commercial potential. To date, this program has already generated through collaborative efforts many approved biopharmaceutical products to benefit the public health. Over the past twenty-five (25) years the NCI, being the largest of the NIH institutes, has generated a significant invention, patent, license and alliance management portfolio. Recent studies on the management of license agreements have reported that license revenue remains one of the most poorly managed and underutilized asset in the United States. For the NCI, proper management of its Intellectual Property (IP) license portfolio necessitates the implementation of a comprehensive assessment. Therefore, NCI has a need for an effective appraisal of license agreements involving NCI lead inventor technologies to verify that milestones are met and patent reimbursement costs are paid in order to ensure that its inventions are being developed and that the Institute is being reimbursed for the funds expended to maintain patent protection. In order to expedite the review and analysis of NCI?s license agreement portfolio, the Technology Transfer Branch (TTB) proposes hiring a contractor to read and review its commercial license agreements and Inter-Institutional Agreements (IIAs); determine if the agreement includes patent cost reimbursement; and identify milestones and payments described in the license agreement. Minimum Contractor Qualifications: 1) Contractor shall have a J.D. degree with patent experience and/or be a patent agent and 2) Have at least two (2) years experience in the analysis of patent license terms and obligations. Maynard and Associates, Inc is the only known source that can provide the expertise needed in patent license portfolio inventory and regulatory drug review. They have access to the NIH proprietary data software and are quite adept and skillful in acquiring resources and information for completing this sophisticated requirement. Maynard and Associates has over twenty (20) years experience in patent licensing, regulatory drug review across NIH as well as experience working in law and with the Federal Drug Administration (FDA). NCI?s patent license portfolio assessment is complex and spans over twenty five (25) active licenses which require very specific access to OTTs? proprietary data software. There are no known contractors to the NCI that can provide the expertise, experience and access to this proprietary data. To bring another contractor to the NCI with the qualifications necessary to access this data would require extensive training in patent and licensing analysis and would be quite costly to the Government. This is not a request for competitive quotation. However, if any interested party believes it can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities and any other information furnished must be in writing and must contain material in sufficient detail to allow the NCI to determine if the party can perform this requirement. An original and one copy of the capability statement must be received in the contracting office by 1:00 pm EDT on August 15, 2006 to Malinda Holdcraft, Contract Specialist. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No collect calls will be accepted.
