Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Government may make a single award, multiple awards, or no award, depending on proposals received and the ability of the Offerors to meet the needs of the Government. CLIN Description Qty Unit of Issue Total Grand 0001 Nonpersonal services for legal services 12 mo $ $ 0002 Travel (NOT TO EXCEED) 1 lo $10,000 Attachments: A Statement of Work B 1 Clauses and Provisions 2 Proposal Instructions & Evaluation Criteria Attachment A Statement of Work Advisory services to the RCLO July 1, 2006 1.0 Background The Regime Crimes Liaison’s Office (“RCLO”) provides assistance and advice to the Iraqi High Tribunal (“IHT”). The IHT is responsible for trying Saddam Hussein and other members of the former Iraqi regime for gross atrocities inflicted upon the Iraqi people. The RCLO requires two attorneys with international law experience (the “Contractor”) to augment the highly skilled team of Assistant US Attorneys, Service JAGs and US Government investigative agents working with the IHT. The Contractor is expected to provide investigative, administrative, logistical, and other support as well as confidential legal advice to the RCLO and the IHT. The RCLO is presently assisting the IHT in investigating six cases, although the IHT may add more cases in the future. Location of the assignment is in Baghdad, Iraq (the International Zone) working principally in the U.S. Embassy or the IHT courthouse. The US Government will provide housing, meals and laundry service. 2.0 Scope The Contractor agrees to provide confidential legal advice as well as investigative, administrative, logistical, and other support to the RCLO and the IHT for a period of one year. 3.0 Detailed Technical Requirements 3.1 The Contractor shall carry a cell phone (which the RCLO will provide) with him so that the IHT and RCLO can contact him whenever necessary. 3.2 The Contractor shall report to work five days per week (Sunday through Thursday) and shall perform his duties during normal work hours. The Contractor shall work on Fridays and Saturdays and at hours which are outside the usual work schedule depending on need. The Contractor is obligated to work during these times if needed and shall not receive overtime pay or additional compensation. 3.3 The Contractor assists the RCLO and IHT by providing general advice relative to international law in conjunction with relevant issues of planned or ongoing cases, to provide legal advice in ongoing trials before the IHT, and to assist the RCLO in providing logistical, administrative, and other support to the IHT Judges, Prosecutors, and Defense Attorneys (either from the IHT Public Defense Office or privately retained attorneys) as necessary. Such work may include, but is not limited to, the drafting of legal memoranda on behalf of the IHT, working with the RCLO and IHT to provide security and administrative support to the IHT, and to take all reasonable measures consistent with law which ensures that the IHT is competent and able to perform its duties. 3.4 The Contractor shall be a contractor directly to the RCLO and subject to all relevant Department of Justice, RCLO, and US Embassy regulations, guidelines, rules, and personnel policies.. 4.0 Administrative Requirements 4.1 The Contractor is obligated to submit invoices at the end of each month to the RCLO in order to receive payment for his services. Should the Contractor fail to submit such invoices to the RCLO, he or she will not receive timely payment. 4.2 The Contractor shall report to the RCLO Chief of Staff (the COTR) for all administrative and other needs. The Contractor understands that the RCLO Regime Crimes Liaison, Deputy Regime Crimes Liaison, and/or Chief of Staff may review his work to ensure that the Contractor is fulfilling his duties as required under the Contract. 4.3 The Contractor shall perform all duties pertaining to his job in Baghdad, Iraq and in office space which the RCLO will provide. The Contractor shall travel outside of Iraq and work in other locations inside of Iraq and outside of Iraq as required. 4.4 The Contractor shall dress as appropriate for his position. This means that he or she must wear business attire (i.e. a business suit) when attending trial sessions. During regular work hours the Contractor shall wear suitable clothing (“business casual”) suitable for his or her position.. 4.5 The Contractor understands that he or she will be providing confidential legal advice to the RCLO and IHT and that this information is protected by the attorney-client privilege and/or may constitute attorney work product, both of which are protected from disclosure to third parties. The Contractor understands that he or she must not disclose any information or legal advice pertaining to his work with the RCLO and IHT unless he or she receives the express written consent of the IHT and the RCLO. 5.0 Deliverables 5.1 The Contractor is obligated to provide a monthly status report regarding his activities to the RCLO and to the IHT. This status report should describe the Contractor’s accomplishments over the previous month and set forth objectives for the following month. This shall accompany the invoice. Attachment B 1. The North American Industry Classification System (NAICS) code and small business size standard are: 541199, $6.5M. 2.2 PROPOSAL INSTRUCTIONS Proposals shall consist of the following information: Technical Proposal and cost package to include the representations and certifications, or information that the offeror has completed the data via ORCA. 2.2.1 The Technical Proposal shall include a resume which demonstrates a familiarity with international criminal law and skill in assembling complex international criminal law cases. Relevant experience before an international criminal tribunal such as the International Criminal Tribunal for the Former Yugoslavia or the International Criminal Tribunal for Rwanda would be rated more highly. 2.2.2 The Offeror shall prepare a cost proposal that provides a breakdown of proposed labor rates. Travel shall be included with a not to exceed total price of $10,000.00 2.2.3 All Offerors are advised that this solicitation includes the clause at FAR 52.212-4 for commercial items which at paragraph (t), Central Contractor Registration (CCR), requires all contractors doing business with the Federal Government after September 30, 2003, to be registered in the CCR database. Offerors should include their Data Universal Number System (DUNS) number in their quotes. The Contracting Officer will verify registration in the CCR database prior to award by entering the potential awardee’s DUNS number into the CCR database. Failure to complete the registration procedures outlined in this clause may result in elimination from consideration for award. 2.2.4 The above information must be received at the Regime Crimes Liaison’s Office, U.S. Embassy, Palace Annex, Room S-115, Baghdad, Iraq, on or before 10:00 AM. (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers (listed in descending order of importance): (i) technical capability as shown by a detailed resume showing information which will meet the Government requirement as described in 2.2.1 above and the SOW; and (ii) price. The technical factor is more important than the price factor. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
