Description

The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1, only one source will satisfy agency requirements (10USC 2304?) DESPCRIPTION OF THE PROPOSED CONTRACT ACTION: The US Army Corps of Engineers, Savannah District intends to issue a firm fixed price commercial service purchase order to Vanguard Modular Building Systems, Malvern, PA through solicitation no. W912HN-06-T-00 65, pursuant to the authority of FAR Parts 6.3, 12 and 13.501(a) Sole Source Acquisitions. Vanguard Modular Building Sytems will provide continued leasing of one Triple Wide Modular Office providing approximately 1960 square feet that is currently located on federal property at Hunter AAF, Savannah, Georgia. The acquisition shall include all existing setup, skirting, ramps and decks, awnings and utilities. The lease is to be for a total of 5 years, one base year with four 1-year options, there will be ad ditional options for the purchase of the office unit at the end of the lease and/or the teardown and return of the unit at the end of the lease. The period of performance for all lease years would be 17 Jun 2006 through 16 June 2011. The solicitation doc ument and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-05. The proposed contract action is for a lease which the Government intends to solicit and negotiate with only one source under the authorit y of FAR 13.501. There is only one responsible source and no other services will satisfy agency requirements. Vanguard Modular Building Systems is the only source capable of providing leasing for the existing office modular unit. A justification for Oth er than Full and Open Competition has been prepared in support of this acquisition. The provision at FAR 52.212-1, Instruction to Offerors, applies to this acquisition to the extent consistent with a sole source acquisition. Offerors shall include a comp leted copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. The clause at FAR 52.212-4, Contract terms and Conditions- Commercial Items, applies to this acquisition. The clause at FAR 52.212-5 , Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. This is not a solicitation nor is it a formal request for proposals. All interested parties must submit a capability stateme nt that sufficiently describes their qualifications, capabilities and previous experience related to fulfilling similar requirements via email to: Cheryl.a.jackson@sas02.usace.army.mil not later than 16 May 2006 at 10:00 am. A determination by the Government not to compete this proposed contract ba sed on responses to this notice is solely within the discretion of the Government. This is a combined synopsis/solicitation for comm ercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will no t be issued.
