- Description
- The subject RFP requires the prime contractor to provide data describing contemporary labor progression in the United States population and to compile and deliver a large database with data on 200,000 deliveries that is suitable for data analysis. The data will need to be acquired by the resultant prime contractor from organizations that are considered “other than small businesses,” such as health care providers and hospitals, via the issuance of subcontracts. As stated in the RFP, the Government estimates a total of 75% FTE per subcontract based on a subcontract that will be supplying 10,000 records. Therefore, the Government’s subcontract effort estimate, as stated in the RFP for the estimated 20 subcontracts needed to supply the 200,000 records, equates to 31,200 hours (75% FTE per subcontractor * 20 subcontracts) based on a 2080 hour work year. This total significantly exceeds the Governments’s total effort estimate for the prime contract of 12,376 hours (see Article L.1.e of the RFP). As a result, the Government’s total estimated cost of the Direct Labor for the subcontracts is also significantly more than the total estimated cost of Direct Labor for the prime contract. Consequently, it has been concluded that there is virtually no chance that a small business offeror could provide a proposal with realistic and reasonable estimated Direct Labor costs for the prime contract and subcontracts that would not be in violation of the legal limitations on subcontracting for a Total Small Business Set Aside. Specifically, FAR 52.219-14, Limitations on Subcontracting, states that, for services (except construction), at least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern (i.e, prime contractor). Therefore, the subject RFP is hereby changed from a Total Small Business Set Aside to full and open competition. Please note that this action has been approved by the NIH Small Business Specialist and the Small Business Administration.
