Description
This is a sources sought for the National Institutes of Health, NIH. The purpose of this sources sought notice is to find qualified, certified, and interested Service Disabled Veteran Owned Disabled, HUBZone 8(a), 8(a), small business, and large business companies who can provide critical services to support the mission of the National Institutes of Health, Office of Technology Transfer, Rockville, MD. The purpose of this project is to provide patent maintenance and annuity fees for the protection of inventions of Public Health Service employees in foreign countries. Countries general included, but not limited to Japan, Canada, Australia and the European Patent Office. Offerors must be knowledgeable of patent laws in each foreign country. Examples of these services are listed in the SOW below. These services are required for a period of one year with four, one-year option period. Closing date will be 30 calendar days from date of this notice. Interested parties are invited to submit a statement of capability addressing the ability to satisfy the above requirement to National Institutes of Health, Attn: Terita Stevenson, Contract Specialist, 6011 Executive Blvd., Room 539C, Rockville, MD 20892, to be received no later than 28 November 2005. The statement of capabilities should be no more than ten (10) pages and include the following information: (1) Name and Address of the Organization, (2) If the 8(a) firm is Hubzone or Service Disabled Veteran Owned Disabled , small business, 8(a) Type, (3) Point of contact with name, title ; Voice Telephone Number; Fax Telephone Number; Internet e-mail address (if any), (4) DUNS number, (5) Contractors capability statement addressing the issues listed above, (6) List of organizations to whom similar types of services have been previously provided to include contract number, dollar value, name and phone number of contracting officer. A Request for Proposal is anticipated to be released in the future. This synopsis is for information and planning purposes and does not constitute a formal solicitation. The Government does not intend to award a contract on the basis of this synopsis or to otherwise pay for the information solicited herein. After Government issuance of the RFP, all responsible sources may submit an offer which will be considered. This Sources Sought Synopsis is in support of market research being conducted by the NIH to identify potential any 8(a), Service Disabled Veteran Owned Disabled or Hubzone 8(a), small business, or large business sources that are capable of performing this requirement. All vendors/prospective contractors must be registered with the Central Contractor's Registration (www.ccr.gov) prior to award date. If not registered or active by that date, vendor proposals will be considered non-responsive. ANY INTERESTED HUBZONE OR SERVICE DISABLED VETERAN OWNED DISABLED 8(A) FIRM , 8(A), SMALL BUSINESS, and LARGE BUSINESS should submit an original and one copy of their capability statement which demonstrates the firm's ability to perform the key requirements described above. Standard company brochures will not be considered a sufficient response to this Sources Sought Synopsis. At a minimum, each 8(a) company, small business shall provide capabilities/knowledge/experience specific to the Statement of Work (SOW). Also, a firm must demonstrate they have the necessary personnel with demonstrated experience, labor, materials, services, equipment and facilities to support the efforts detailed in the Statement of Work (SOW). THIS SOURCES SOUGHT IS FOR INFORMATION AND PLANNING PURPOSES ONLY AND IS NOT TO BE CONSTRUED AS A COMMITMENT BY THE GOVERNMENT. NO REIMBURSEMENT WILL BE MADE FOR ANY COSTS ASSOCIATED WITH PROVIDING INFORMATION IN RESPONSE TO THIS ANNOUNCEMENT AND ANY FOLLOW-UP INFORMATION REQUESTS. RESPONDENT WILL NOT BE NOTIFIED OF THE RESULTS OF THE EVALUATION. ALL INFORMATION SUBMITTED IN RESPONSE TO THIS ANNOUNCEMENT MUST BE RECEIVED ON OR BEFORE THE CLOSING DATE. THE CLOSING DATE FOR RESPONSES IS November 28, 2005 at 3PM EST. Faxed and emailed capability statements are NOT authorized. Below is a copy of the statement of work: STATEMENT OF WORK Independently, the contractor will provide the necessary professional services to pay patent maintenance and annuity fees for the National Institutes of Health. Specifically, the contractor will provide the services listed below. 1. Maintain records of all patents which have been filed with the United States Patent and Trademark Office (USPTO) and foreign countries by the Office of Technology Transfer (OTT), NIH. 2. Provide the OTT Project Officer with the below listed reports of patents which require maintenance or annuity fees to be paid with the estimate of cost in U.S. dollars for each patent. Separate reports will be provided on the patents filed in the United States and foreign countries. Each report will be organized and subtotaled by government organizational component and provide a grand total of fees to be paid. a. Submit no later than five (5) months prior to a quarter, a Quarter Tax Review Report of Patents that requires a fee to be paid. b. Submit three (3) months prior to the beginning month of the quarter, a Quarterly Tax Review Report of Patents. The OTT Project Officer may return one (1) copy of the report to the contractor with proposed pay and drop decisions. c. Submit no later than two (2) months prior to the beginning month of a quarter, Invoice Reports of Patents which will include the following: 1) Summary – For foreign countries, include the amount due to the contractor for each country divided by the OTT Project Officer. 2) Detail – Lists of the total amount due the contractor for each case. Refer to Section G, Contract Administration Data, below for further invoicing instructions. d. Submit one (1) month prior to the beginning of the month or quarter, Invoice Report of Patents. The OTT Project Officer will return a copy of the report that will indicate any last minute decision changes and will include a detailed listing showing which cases are to be added or deleted. Payment will be processed as stated in Section G. e. Provide two (2) Post Invoice Reports after payment of the invoice: 1) Paid Cases – List of the annuities identifying the cases paid and the actual amount paid. For foreign countries, the amount paid will be shown in the foreign currency. 2) Non-paid Cases – List of the cases with a tax due which were not paid by the contractor. f. After payments are made, the contractor will submit a Settlement Report listing the debits and credits which have occurred since the invoice date. 3. Pay annuities by the due date as designated from the reports submitted to and agreed to by the OTT Project Officer. 4. Examine the impact of adjustments or revisions in the patent annuity or maintenance fees of the United States and foreign countries with whom the NIH has activity and advise the OTT Project Officer as to action that needs to be taken to meet those changes. 5. Treat all information as strictly confidential. 6. Maintain all such information and the media on which it is stored with the full understanding that they are the exclusive property of the Government. At the completion of the contract, this information and media will be delivered to the Government or the successor contractor at the direction of the OTT Project Officer.
