Description
MARKET RESEARCH (SHIPOWNERS/CHARTERERS COMMERCIAL PRACTICE) The Military Sealift Command (MSC) is conducting market research into commercial practices of ship owners and charterers in contracts for time and voyage charters. This market research is for informational purposes, and the Government will not pay any cost incurred in the preparation or submission of responses. The Federal Acquisition Regulations provide provisions and clauses intended to address, to the maximum extent practicable, commercial market practices. Some of these clauses may be tailored by the Contracting Activity without higher level approval to the extent that they are not inconsistent with commercial practice A revised proforma (master solicitation) for the time charter of dry cargo vessels has been posted to the Military Sealift Command website (http://www.msc.navy.mil/) in the "Contracts" portion of the website under "Requests for Information/Market Surveys". Tailored provisions and clauses are indicated in bold in Parts II ("FAR 52.212-4 CONTRACT TERMS AND CONDITIONS - COMMERCIAL ITEMS") and X ("FAR 52.212-1 INSTRUCTIONS TO OFFERORS-COMMERCIAL ITEMS") of the proforma. Request interested firms provide the following information via facsimile or e-mail to Susan Marie Paolini by 3 March 06 (Phone: (202) 685-5930; Facsimile: (202) 685-5942; e-mail: susan.paolini@navy.mil). (1) Name of firm and point of contact (including phone and e-mail) (2) List of tailoring in the DRYTIME 06 proforma that does not conform to firm?s commercial practice. (3) For those clauses identified in paragraph (2) above, provide sample terms and conditions showing firm?s customary commercial practice. Include narrative explaining the context or applications where the sample language would be used. (4) Customary practices regarding negotiating, modifying or tailoring of customary commercial contract terms and conditions to meet owner or charterer's needs. (5) Other best commercial practices recommended for consideration by the Government.
