Suitable technical data, government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Data review discloses that required data or data rights are not in the Government possession and cannot be economically obtained. Authority: 10 U.S.C. 2304 (C) (1), Justification: Supplies (or Services) required are available from only one or a limited number of responsible source(s) and no other type of supplies or services will satisfy agency requirements. The proposed contract action is for supplies and services for which the Government intends to solicit and negotiate with only one, or a limited number of sources under the authority of FAR 6.302. Subject to the Government’s consideration, a viable source, not already qualified to provide the requisite services, should submit a concise and program specific response presenting sufficient information to substantiate that they have (1) the necessary knowledge and understanding of the requirements; 2) employees with satisfactory qualifications; and 3) appropriate repair knowledge and experience to be able to provide the services required without technical, schedule or cost risk to the ICBM and/or similar ICBM programs prior to contract award. A Determination by the Government not to compete this proposed contract based upon responses to information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
