Description
The announcement of solicitation 2005-Q-01129 posted on July 18, 2005, whereby CDC intended to compete a requirement for transmission electron microscopy (TEM) analysis of airborne fiber samples using two modifications of the International Organization for Standardization (ISO) Direct-Transfer Method (10312, 1995-05-01 is hereby modified to cancel the competition and reissue this notice indicating that this requirement shall now be processed as a sole source action to EMS Laboratories in Pasadena, CA. To perform the comparison under the initial competitive announcement, CDC would need to release the Berman TEM counting method to the public. At the time of the original posting, it was believed that the interagency agreement between NIOSH and the EPA granted NIOSH the rights to release the Berman method. However, NIOSH has since discovered that the Berman TEM modification method was submitted under a prior EPA contract containing FAR Clause 52.227-14, Alternate II (June 1987) which granted the Government only limited rights to the data with no right to disclose the data outside the Government without his written permission. Since we are unable to release the Berman TEM counting method, a determination has been made that CDC will issue the purchase order to EMS Laboratories for this comparison because Berman previously disclosed his method to EMS for analysis work in the past.
