Description
The Netherlands Ministry of Defence intends to advertise for International Competitive Bidding (ICB) on works and services within the framework of the NATO Security Investment Program. Eligible firms will be invited to bid for the restoration by replacement of the Pernis-Woensdracht-Schoten Pipeline. The estimated cost for execution of the works is approximately Euro 25 million (USD $30 million). The Netherlands serves as the Host Nation for this project, which was fully authorized by the Infrastructure Committee under one-step bidding procedure. The reference of the Invitation for International Bid (IFIB/IFB) to be issued is MG2005000839 and all correspondence in relation to this procurement shall refer to this reference. The U.S. Department of Commerce will be using the reference ICB-NETHERLANDS-2005-ADO-05-097-MG2005000839. The project is NATO UNCLASSIFIED. The NATO serials for this project are 2PL12026-0 and 2PL09384-0. SCOPE OF PROJECT The projects involve the detailed and final design, the application for licenses, and the construction of an 83 km 10-inch steel pipeline with an operating pressure of 80 bars between Pernis depot (the Netherlands) and Schoten depot (Belgium). This includes the adaptation of the Pernis high pressure pump station into an electric driven pump station and adaptations of the manifolds in both Pernis and Schoten. The projects are described in NIS screening report AC/4(PP)D24871 dated 9 September 2004. Although the projects are planned in Belgium and the Netherlands, the projects will be handled as one complete project with one contract for both countries. The contract will be of the type (final) design and construction and will be based on the Dutch administrative conditions known as the Uniforme Administratieve Voorwaarden voor Gemtegreerde Contracten 2005. Box 37, 6710 BA EDE, The Netherlands; www.crow.nl) As Dutch is a mutual language to both Host Nations, all project communication and information will be in the Dutch language. Required skills of the potential contractor should be in the field of engineering and construction. With respect to engineering capabilities, experience with calculations as described in the NEN 3650 and NEN 3651 Pipeline code is required to finalize the different license requests. With respect to the construction phase, specific capabilities with respect to construction capacity, planning, and quality assurance are required. The construction of the pipeline will be split into 2 consecutive phases. During the first phase, approximately 50 km of pipeline is to be constructed in a new pipeline route of the Stichting Buisleidingenstraat Nederland. (Information available at: Bureau Stichting Buisleidingenstraat Nederland, Wilhelminastraat 12, 4701 GX, Roosendaal, The Netherlands; www.buisleidingenstraat.nl) The second construction phase is planned to last at maximum a period of 3 months. During that period, the existing pipeline needs to be purged and removed over a length of approximately 30 km, while at the same time installing the new 10-inch pipeline and finalizing all works to prepare the total pipeline for operational use. Concerning construction capacity, the contractor needs to be capable of constructing at least 1 km of 10-inch pipeline per day. In this context, it is important that the contractor be responsible for all purchases of required materials, including the long lead items as the line pipe and the new electric-driven high pressure pump sets. With respect to planning and quality assurance, the contractor has to prove, before and during execution of the construction projects, that the working plan, organization, and quality control guarantee that the new pipeline system is built according to the specifications and is fit for operational use on schedule. TECHNICAL REQUIREMENTS Experience with the engineering of a pipeline for the transport of dangerous fluids of at least 10 kilometers and an operating pressure of 16 bars or higher for at least 3 projects over the last 3 years. References need to show that the potential contractor has experience with engineering according to the NEN 3650 and NEN 3651 and managing the application of licenses in both Belgium and the Netherlands. Experience with the construction of high-pressure pipelines of at least 20 kilometers length and a diameter of at least 8 inches (and higher) for at least 3 different projects over the last 3 year. References need to show that the potential contractor has the required construction capacity and experience for realizing a 20 kilometers pipeline within a period of 4 months and that the potential contractor is capable of constructing 1 kilometer of 10-inch pipeline per day. Experience with installation or adaptation of at least 1 high pressure pump station and accessories with a pump capacity of 500 kW, for which the potential contractor acted as main contractor. Experience with contracts of the type design and construct (contract value Euro 15 million/USD $18.2 million for a minimum) for at least 3 projects over the last 3 years, for which the potential contractor acted as the main contractor. FINANCIAL/LEGAL REQUIREMENTS 1) The potential contractor must be registered with the Chamber of Commerce. 2) The potential contractor must not be in the following exclusion situations: (a) Bankrupt or in the process, activities having ceased, or the subject of a suspension of payment or a scheme of arrangement or in a similar situation resulting from national legislation or arrangements. (b) Bankruptcy filed for or against with a procedure for suspension of payments or a scheme of arrangement instituted or any similar procedure resulting from national legislation or arrangements. (c) Convicted by a non-appealable final judgment for an offense that by its nature is detrimental to the professional ethics of the firm. (d) Committed a grave error in the course of business, established on any grounds that can be made plausible by the contracting department. (e) Has not fulfilled its obligations at the time of application and/or bid to pay the Social Security contributions in compliance with the statutory provisions of the country in which it is established or those of The Netherlands. (f) Has not fulfilled its obligations at the time of application and/or bid to pay taxes in compliance with the statutory provisions of the country in which it is established or those of the Netherlands and Belgium. (g) Guilty to a considerable extent of giving false statements when providing information. 3) The trade volume of the potential contractor over the past 3 years must be at least: (a) For engineering of pipelines and accessories Euro 1,200,000 (USD 1,460,000) per year exclusive VAT. (b) For construction of pipelines Euro 50,000,000 (USD 60,670,000) per year exclusive VAT. (c) In case potential contractors have the intention to form combinations to fulfill the requirements as set out in this document, the above mentioned trade volumes have to be increased by 25% for a combination of 2 firms and by 50% for combinations of 3 or more firms. 4) The debt to equity ratio should be 0.25 or higher. 5) The current liabilities to current assets ratio should be 1 or higher. GENERAL REQUIREMENTS The potential contractor must be able to build up a project team for this project. The team must be headed by a project manager, a project leader for engineering and a project leader for construction, all qualified (at least a B.Sc. in Civil or Mechanical Engineering with at least 10 years relevant experience or other education level and at least 15 years relevant experience). As a minimum, the reference should indicate how the potential contractor plans to obtain, maintain, and utilize, within the outlined project organization, the necessary (proficient) knowledge of the Dutch and Belgium construction laws and relevant regulations, including the required communication and correspondence in Dutch. The potential contractor must be certified for an adequate quality system according to ISO 9001 with respect to engineering and construction of pipelines. The potential contractor must be in the possession of an SCC certificate (Safety Health Environment Checklist Contractors) for the Netherlands and for Belgium. For Belgium the contractor has to fulfill the requirements as set out in the Erkenningsregeling for class 7 and category C2. A copy of the certificate or the request to become acknowledged is required. For the Netherlands, the nature of the projects requires that the potential contractor has a permit to establish a business according the vestigingswet bedrijven 1954. Companies not having a residence in the Netherlands, and lacking a registration at one of the Dutch Chambers of Commerce, can obtain a permit or release via the Chamber of Commerce in Rotterdam (information available at www.kv.nl). A copy of the permit or release is required. ELIGIBILITY Bidders will be subject to an audit on technical, financial/legal, and general aspects to verify the qualification criteria. For this purpose a questionnaire will be used; all requested information on the questionnaire, e.g. certificates, licenses, and project reference descriptions, needs to be available by the bid closing date. Interested firms must be nominated by their National Authorities with the required Declaration of Eligibility. REQUESTS FOR PARTICIPATION RECEIVED DIRECTLY FROM FIRMS CANNOT BE CONSIDERED. IMPORTANT DEADLINES 1. Final date for the U.S. Embassy in The Hague to submit a Declaration of Eligibility (nomination letter) on your behalf: August 24, 2005. 2. Anticipated date that the Invitation for International Bidding (IFIB/IFB) will be forwarded to those on the Bidder List (distribution of the Cahier des Charges): late October 2005. 3. The closing date for receipt of bids is scheduled for January 2005 (10 weeks after the issue of the IFB/Cahier des Charges). The minimum required period of bid validation is 6 months. CERTIFICATION THE U.S. DEPARTMENT OF COMMERCE DOES NOT SERVE AS THE CONTRACTING AGENCY FOR NATO PROJECTS. HOWEVER, ALL FIRMS WHOSE FACILITY IS LOCATED WITHIN THE UNITED STATES MUST BE CERTIFIED BY THE U.S. DEPARTMENT OF COMMERCE IN ORDER TO QUALIFY TO BID FOR THIS PROCUREMENT. The contracting entity is the Defence Infrastructure Agency of the Netherlands Ministry of Defence. Only firms that the U.S. Department of Commerce has certified as eligible will be allowed to bid. A Declaration of Eligibility (nomination letter) will be submitted on their behalf to the U.S. Embassy in The Hague, which will in turn provide the Declaration of Eligibility to the contracting entity.
