Description
The Naval Surface Warfare Center Panama City (NSWC PC) intends to issue a five-year Indefinite Delivery Indefinite Quantity (IDIQ) contract on a sole source basis to EDO Marine and Aircraft Systems, North Amityville, New York 11701-4840. This IDIQ contract includes a variety of engineering services for the repair and conversion of the MK 105, Organic Airborne and Surface Influence Sweep (OASIS), and the Precise Navigation System (PNS). The use of task orders will provide the flexibility necessary for the different types of work required. Under this IDIQ EDO will provide for repair, modification and overhaul of the MK 105, OASIS and PNS systems. This includes all depot repairs and incorporation of Engineering Change Proposals (ECP), including the generation of all Integrated Logistics Support documentation to support the conversions. This effort is unsuitable for full and open competition for the following reasons. a) EDO is the original equipment manufacturer (OEM) and the only source for the three systems listed above. As such, only EDO has the expertise, technical data, equipment, and experienced personnel to successfully complete the system overhauls and supporting documentation as well as the other tasking specified above. EDO has been the sole developer of the OASIS system including the award of the Systems Design and Development (SD&D) Contract (Contract No. N00024-02-C-6316 in fiscal year 2002. There have been no other contractual actions related to the direct development of the OASIS system since award of this contract. The Government does not own the fully validated technical data package (TDP) and will not own the TDP until the end of contract N00024-02-C-6316, which is scheduled for completion in fiscal year 2006. EDO is the Depot facility for the above Airborne Mine Counter Measures (AMCM) systems. By PMS-495 direction, EDO is the Software Support Activity and the D! rawing Configuration Manager for the MK 105, OASIS, and Precise Navigation systems. The Government views all software and drawing changes, but the software and drawings reside at EDO under Contractor control. b) Given the complexity of the MK-105, OASIS, and PNS systems and the level of system knowledge required to overhaul and repair this complex equipment and systems, EDO is the only source possessing the expertise, internal technical data, equipment, and experienced personnel necessary to successfully provide the engineering and design services to accomplish all tasking. c) This is a follow-on contract for the acquisition of engineering services for continued development of a major system or highly specialized equipment, including major components thereof, within the exact meaning of FAR 6.302-1(a)(2)(ii). Use of any other vendor would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. In summary, there are no other possible sources that can satisfy this requirement without significant additional cost, significant schedule risk and significant technical risk to the Government. Note 22 applies.
