Description
COMMERCIAL LAW DEVELOPMENT PROGRAM REQUEST FOR INFORMATION / SOURCES SOUGHT The Commercial Law Development Program (CLDP) of the U.S. Department of Commerce, Office of the General Counsel, is a technical assistance provider working on the development and implementation of laws and international agreements affecting trade and investment in over 35 countries worldwide including the former Soviet Union. CLDP is in need of contractors to perform technical assistance within Metropolitan Washington DC and varied international locations, and would like to materially improve our understanding of the current state of the marketplace, particularly as regards to those business concerns eligible under FAR PART 19, Small Business Programs. FUNCTIONAL AREA #1 ? Technical Assistance to the Government of Tunisia regarding Trade and Investment Framework Agreement (TIFA) Description of Work Provide technical assistance to the Government of Tunisia to ensure compliance with the Trade and Investment Framework Agreement (TIFA). An integral part of this assistance has previously been capacity building in the management of Tunisian technology-based Small and Medium Enterprises (SMEs). Work would consist of the following: 1. Evaluate the commercial potential, worldwide of new technologies and /or products developed by Tunisian research centers or entrepreneurs; 2. Design an Intellectual Property (IP) protection strategy for new technologies and/or products developed by Tunisian research centers or entrepreneurs and assist these centers or entrepreneurs in implementing their IP protection strategy; 3. Design a strategy to derive licensing revenues from new technologies and/or products developed by Tunisian research centers or entrepreneurs an assist these centers or entrepreneurs in implementing their technology licensing strategy; and a. Design a strategy for transferring to SMEs, new technologies and/or products developed by Tunisian research centers or entrepreneurs. FUNCTIONAL AREA # 2 ? Portuguese Speaking Legal Expert for Angola Description of Work Provide assistance to the Government of the Republic of Angola (GRA) on the modernization of the Angolan Judiciary System. CLDP is seeking a native Portuguese speaker, International Trade Attorney with Government-to-Government experience in working with both the United States Government and officials from Lusophone countries. Contractor is required to have a knowledge base in international trade and trade related legal technical assistance. FUNCTIONAL AREA # 3 ? Equity Financing Expertise for Small and Medium-Sized Enterprises (SMEs) in Algeria. Description of Work Algeria is preparing to accede to the World Trade Organization (WTO) and is reforming its banking and financial system. In particular, Algeria is interested in developing equity financing expertise in the country. CLDP is seeking a Contractor to provide assistance in training future Algerian equity investors in meeting their needs for strategic guidance expressed by managers of SMEs in which the investors will have taken equity positions. Specifically the contractor may be required to assist with the following: 1. Participate in training workshop(s) in Algeria 2. Organize and conduct meeting in the United States, for trainees the contractor will have met in Algeria, with providers of strategic advice to technology SMEs. Such providers will be managers of Venture Capital Firms or Managers of Technology Incubators. FUNCTIONAL AREA # 4 ? Free Trade Agreement (FTA) Expert in Moroccan Administrative Law Description of Work CLDP is seeking a Contractor to provide assistance in documenting FTA-related obligations and in drafting documents of a legal or regulatory nature. In particular the Contractor may be required to: 1. Conduct relevant secondary research on legislation, regulations and practices 2. Synthesize findings into user-friendly charts or reports, as determined by CLDP 3. Provide relevant analysis of such findings as well as recommendations 4. Assist CLDP in drafting documents of a legal or regulatory nature. FUNCTIONAL AREA # 5 ? Provide Technical Assistance to the Government of Bosnia and Herzegovina (BiH) on World Trade Organization (WTO) accession. Description of Work CLDP is seeking a Contractor to provide technical assistance to the Government of Bosnia and Herzegovina (BiH) on World Trade Organization (WTO) accession. BiH is currently in the process of acceding to the WTO. The Contractor will provide technical assistance (acting through CLDP) to the Government of Bosnia and Herzegovina (GOBiH) on WTO issues to further BiH?s accession process. Specifically, the Contractor shall: 1. Work with the CLDP Program Manager in developing a training plan for the GOBiH; 2. Provide advice/assistance on WTO issues including, but not limited to trade in goods (customs matters, tariffs, licensing, Harmonized System, Rule of Origin, etc.), trade in services, investment issues, intellectual property rights, standards, government procurement, and state trading. The Contractor?s advice will be dependent upon the needs of BiH officials as they prepare for Working Party meetings, plurilateral meetings, and other trade matters; 3. Provide assistance to the GOBiH in the preparation of documents and materials submissions to the Working Party; 4. Maintain close liaison with U.S. and BiH Negotiators to ensure that the advice and assistance provided meet the needs of the WTO accession and compliance processes. The Contractor will not be part of the negotiating team nor participate in the formulation of negotiation strategies; INSTRUCTIONS Contractors are requested to provide a brief capability statement addressing their qualifications and a summary of past experience for each Functional Area selected. In addition, Contractors should note any applicable Size Standards and provide their business classification (Small, Large, HUBZone, etc.) Please limit capability statements to a maximum of five (5) pages per functional area selected.
