Description

This is a notice of intent to award, on a sole source basis to the Portrait Brokers of America, of Birmingham, AL, for commercial items prepared in accordance with Simplified Acquisition Procedures and within the format identified in FAR Part 12. This announcement constitutes the only solicitation; on behalf of the Office of the Attorney General, the Department of Justice, has a need for the services a professional artist to prepare a 3/4 length Official Government [wall] portrait [oil painting] of the former Attorney General, the Honorable John Ashcroft. The finished portrait shall be displayed in a place of distinction, either in an office of a senior official or with public space, within the Department of Justice. Historically, upon leaving office, a portrait of the Attorney General is painted for inclusion in the Department?s Official Portrait Collection of Past Attorneys General. It is customary and permissible for the Attorney General to select the artist. Mr. Ashcroft has selected, the artist, Mr. John Howard Sanden to create his portrait. The provision 52.212-1 Instructions to Offerors?Commercial Items applies to this acquisition. Provision 52.212-2 Evaluation?Commercial Items applies. Quotes are not being request and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 26 effective January 19, 2005. Responses received as a result of this notice of intent shall be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses will not be considered as either proposals or bids. A determination by the Government not to open this requirement to competition, based upon the written responses to this notice, is solely within the discretion of the Government.
