Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR subparts 12 and 13, as supplemented with additional information included in this Notice. This Notice constitutes the only solicitation; proposals are being requested via this Notice. A separate, written solicitation will not be issued. The Internal Revenue Service is interested in acquiring ammunition magazine pouches on a BRAND NAME OR EQUAL basis in support of the IRS Criminal Investigation organization. This is a small business set aside under the stated NAICS Code; the small business size standard is 500 employees. This is a firm fixed price contract. Multiple contract awards are not contemplated. Offers should include pricing for all line items. Offers shall be transmitted to the contract specialist by 4:00 p.m., EST on the due date. Proposal evaluation to determine equality with the cited brand name item will be based on the form, fit and function requirements presented below and prior examination of offered items by the IRS. Technical evaluation factors will be past performance and most advantageous delivery for these mission-critical items. These two factors are approximately equal in importance, and the sum of technical factors is approximately equal to price in importance. To facilitate evaluation, offerors shall include as part of their proposals technical points of contact (name, title, telephone number) and product descriptions for at least three contracts performed during the last three years which were similar to this one in scope and magnitude. This solicitation and the clauses and provisions cited are in effect through Federal Acquisition Circular 2001-27, dated December 28, 2004. The following FAR clauses apply to this solicitation: 52-212-1, INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (01/2005); 52.212-4, CONTRACT TERMS AND CONDITIONS--COMMERCIAL ITEMS (10/2003). The following clauses cited in 52.212-5, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (01/2005) also apply: 52.222-3, CONVICT LABOR (06/2003); 52.233-3, PROTEST AFTER AWARD (08/1996); 52.222-21, PROHIBITION OF SEGREGATED FACILIITIES (02/1999); 52.222-26, EQUAL OPPORTUNITY (04/2002); 52.222-35, EQUAL OPPORTUNITY FOR SPECIAL DISABLED VETERANS, VETERANS OF THE VIETNAM ERA, AND OTHER ELIGIBLE VETERANS (12/2001); 52.222-36, AFFIRMATIVE ACTION FOR WORKERS WITH DISABILITIES (06/1998); 52.222-37, EMPLOYMENT REPORTS ON SPECIAL DISABLED VETERANS, VETERANS OF THE VIETNAM ERA, AND OTHER ELIGIBLE VETERANS (12/2001); and 52.232-33, PAYMENT BY ELECTRONIC FUNDS TRANSFER--CENTRAL CONTRACTOR REGISTRATION (10/2003). Under line item 0001, we are seeking a quantity of 1545 double magazine pouches for Glock 22 and 23, Bladetech 1.75? solid loop, ambidextrous, stealth black OR EQUAL. Line item 0002 encompasses the combined shipping charges for all items, if such charges are not included in the unit price for the pouches. Offerors shall include manufacturer?s name, model number, and description for any item proposed as an equal to the cited brand name product. Equality with the cited brand name will be determined based on the following factors: Kydex material for durability and compatibility with previously purchased holsters, International Defense Pistol Association (IDPA) approval, superior retention of magazines and ease of draw, compatibility with existing holsters in color and quality of materials and quality of workmanship. At the IRS?s discretion, a returnable sample of any item offered as an equal may be required for testing purposes. FAR 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (01/2005) shall be completed and returned by each offeror as part of its proposal. Proposals which do not comply with the requirements of this solicitation will not be considered for award.
