- This is a combined synopsis/solicitation for commercial item(s) prepared in accordance with FAR 12.6, as supplemented with additional information included in this notice. This announcement constitutes the solicitation. Proposals are requested and a w ritten solicitation will not be issued. W91YTZ-04-T-0205 is issued as the Governments intent to award sole source (Note 22) to Fresenius USA for one Fresenius Dialysis System, Model 2008K and one CRRT EPROM. The solicitation document and incorporated Prov isions and Clauses are those in effect through Federal Acquisition Circular (FAC) 2001-24. The SIC Code is 3841; the North American Industry Classification System (NAICS) code is 339112. The North Atlantic Regional Contracting Office intends to issue a fir m fixed price contract at Walter Reed Army Medical Center (WRAMC), Washington DC 20307. The following Provisions and Clauses are incorporated and shall remain in full force in any resulting purchase order: FAR 52.212-1 Instructions to Offerors- Commercial Items; FAR 52.212-2 Evaluation of Commercial Items. Technical capability and price are approximately equal; FAR 52.212-3 Offeror Representations and certifications; FAR 52.212-4 Contract Terms and Conditions-Commercial Items; FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders; FAR 52.222-3 Convict Labor; FAR 52.222-19 Child Labor; FAR 52.222-21 Prohibition of Segregated Facilities; FAR 52.222-26 Equal Opportunity; FAR 52.222-35 Equal Opportunity for Special Disab led Veterans; FAR 52.222-36 Affirmative Action for Workers with Disabilities; FAR 52.232-26 Payment By Third Party; FAR 52.247-34 FOB Destination; FAR 52.252-1 Solicitation Provisions Incorporated By Reference; FAR 52.252-2 Clauses Incorporated by Referen ce; DFARS 252.204-7004 Required Central Contractor Registration, and DFARS 252.212-7001 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items. The Government reserves the rig ht to make award on the initial proposals received without discussions. The Government will consider all quotes received by 27 September 2004. Interested parties must be FDA approved for the manufacture, sale, and distribution of their products.
