Description
NAICS Code: 334516 The U.S. Environmental Protection Agency (U.S. EPA) National Enforcement Investigations Center intends to award a sole source fixed-price Purchase Order using Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures to LECO of St. Joseph, Michigan under the authority of FAR Part 6.302-1. The purpose of this acquisition is to purchase a maintenance agreement for the GC Time of Flight Mass Spectrometer. Included in the procurement of this maintenance agreement are all parts, labor and travel for repairs, along with software upgrade releases, which are continuances of delivered versions. These software releases are only available through LECO, as LECO is the exclusive licensee of the software. LECO has the unique capability to service this machine since no other vendors provide maintenance services for the GC Time of Flight Mass Spectrometer. Therefore, it has been determined that LECO is the only viable source to meet the Government's requirements. The NAIC code for this procurement is 334516. NO SOLICITATION OR REQUEST FOR QUOTE (RFQ) IS AVAILABLE. Notwithstanding, any firm who believes it is capable of meeting EPA's requirement as stated herein may submit a response, which if received within 10 calendar days of the date of this announcement will be considered. Responses to this posting must be in writing. A determination not to compete the proposed Purchase Order based upon the responses to this notice is solely within the discretion of the Government.
