- This is request for information (RFI) issued IAW FAR 15.201(e), for Fiscal Year (FY) end planning purposes. Government funds are currently not available at this time. Should funds become available, a request for quotation (RFQ) will be issued; however, ONLY a short response period will be allowed for such an RFQ due to FY closeout. Therefore, your prompt attention to this RFI is highly encouraged in order for you to be capable of responding to an RFQ should one be issued. Submit only written responses for RFI FA5205-04-I-KM01. An RFQ will incorporate provisions and clauses in effect through Federal Acquisition Circular (FAC) 2001-23 (as of 19 Jul. 2004). This procurement is a Total Small Business Set-aside acquisition. The NAICS code 441222 applies to this solicitation. This RFI contains the following line items: Line Item 0001: One (1) Each, Jet Boat (manufacturer is Water Ventures) or Equal, Part No. 15006 Includes: six (6) seater, 16?7? long, 7?7? wide, 38? high and 1500 lbs. Line Item 0002: Shipping Costs to Tracy, CA. When quoting an ?or equal? item, offeror must submit all descriptive literature, specifications, catalogs, etc., along with their quotation, necessary to meet the requirements of this solicitation to be eligible for award. Offeror must provide the estimated total weight and the total cubic ft for shipping purposes. End Item. FOB point is Destination. PROVISIONS/CLAUSES. The provision at FAR 52.212-1, Instructions to Offerors ? Commercial Item, applies to this acquisition. The provision at FAR 52.212-3, Offeror Representations and Certifications ? Commercial Items, applies to this solicitation and the offeror must include a completed copy of this provision with their proposal. FAR 52.212-4, Contract Terms and Conditions?Commercial Items, applies to this solicitation. The clause at FAR 52.211-6, Brand Name or Equal, FAR 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders ? Commercial Items, FAR 52.232-8, Discount for Prompt payment, applies to this solicitation. The clause at DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statues or Executive Orders applicable to Defense Acquisition of Commercial Items, applies to this solicitation. Specifically, the following DFARS clauses cited are applicable to this solicitation: DFARS 252.232-7003, Electronic Submission of Payment Requests, DFARS 252.212-7000, Offeror Representations and Certifications--Commercial Items. Addenda to FAR 52.212-4: The following additional clauses apply to this solicitation: FAR 52.233-2, Service of Protest: (a) Protest, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the General Accounting Office (GAO), shall be served on the Contracting Officer John L. Walker Jr. (addressed as follows) by obtaining written and dated acknowledgement of receipt from 35th Contracting Squadron, Attn: Mr. Yoshikatsu Nakamura, Unit 5201, APO AP 9639-5201. (b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO. Award will be made to the responsible offeror whose quote/offer represents the best value in terms of technical (capability of item(s) offered to meet the government need), price, and past performance, which will be most advantageous to the government.
