Description
This combine Synopsis/Solicitation is hereby modified to correct the Solicitation number to HSCG38-04-Q-S00034. It is also modified to add the following information due to lack of character spaces on the first posting. 5.4.2. MATERIAL INSPECTION AND RECEIVING REPORTS: At the time of each delivery of supplies or services under this contract, the contractor shall prepare and furnish to the Government a properly completed packaging slip. The packaging slip shall include the following information: (1) National Stock Number; (2) Part Number; (3) Nomenclature; (4) Serial Number; (5) Delivery Order Number; (6) Contract Line Item Number; (7) Quantity. One copy of the packaging slip shall be submitted with the shipment and shall be attached to the outside of the shipping carton, one copy shall be sent to the Contracting Officer upon shipment or delivery and shall be clearly marked "Information Only" and one copy shall be attached to he original invoice when submitted for payment. Failure to do so will result in either nonpayment or delay of the invoice. QUALITY ASSURANCE REQUIREMENTS: Offerors other than the OEM must possess NAVICP-PICA certification as a certified source of supply and must provide proof of such prior to contract award. Information regarding NAVICP-PICA certification may be obtained at www.navicp.navy.mil/sabs/sas/sascover.htm. The contractor shall perform in accordance with applicable Federal Aviation Administration Regulations and Directives. Contractor's FAA rating shall comply with FAR Part 145 Subpart B, Subsection 145.31 and 145.33 dated 1-1-93. If the contractor for any reason looses its certification during the period of performance, this constitutes a material breach of contract and may result in Termination for Cause proceedings in accordance with FAR Clause 52.212-4 (m). The Contractor shall notify the Contracting Officer verbally and in writing no later than 5 calendar days after certification forfeiture disclosing events that caused such actions. 7.0. GOVERNMENT PROPERTY FURNISHED FOR REPAIR: Failure of the Government to furnish such items in the amounts or quantities described in the Schedule of Supplies/Services as "estimated" will not entitle the contractor to any equitable adjustment in price under the Government Property clause of the contract. The Government reserves the right to do depot level overhaul of the components described in the Schedule of Supplies/Services. 8.0. PERFORMANCE REQUIREMENT SUMMARY: The Contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance standard briefly describes the minimum acceptable levels of service for each requirement. These thresholds are critical to the mission success. Service Requirement 5.1 Performance Objective Receipt of Parts Performance Threshold Notify the Contracting Officer with the required information in a timely manner. Surveillance Method Customer Complaint 5.2 Overhaul Complete all required overhauls to unserviceable components in accordance with the specifications of paragraph 3.0. Customer Complaint 5.3 Reassembly and Performance Test R eassemble all overhauled components and conduct a performance test in accordance with the specifications of paragraph 3.0. Customer Complaint 5.4 Reports/Forms Submit all required reports/forms in a timely manner. Customer Complaint NOTICE FOR FILING AGENCY PROTESTS. It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the Coast Guard as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external form. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman. Informal forum with the Ombudsman. Interested parties who believe that a Coast Guard procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the Coast Guard Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester's concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency's goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103(d)(2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e).
