Description
The National Institute of Standards and Technolgy (NIST), Acquisition and Logistics Division intends to negotiate on behalf of the Semiconductor Electronics Division with Carl Zeiss, Inc. of Thornwood, NY, for the upgrade of an existing Zeiss Pascal Confocal Fluorescence Imaging Microscope System, purchased in 2002 from Zeiss. Under the authority of 41 USC 253 (c)(1), Only one responsible source, Carl Zeiss Inc. is the only manufacturer capable of successful completion of this equipment upgrade. Sole source determination is based on the following: (1) Under the original award, Zeiss offered the opportunity for NIST to upgrade the instrument from a model Pascal system to a model LSM 510 Pascal System and credit the returned parts towards the cost of the upgrade if the upgrade would take place within 2 years of the original purchase. The major parts that will be upgraded are the scanning head and the controller electronics for the scanning head; (2) The scanning modules and scanning heads of the model Pascal and model LSM 510 are proprietary designs to Zeiss; (3) Zeiss is the only manufacturer that provides simultaneous multi-color detection and Meta detection for spectral response measurements. In our present application, NIST requires the ability to measure multi-color emission (different wavelengths) simultaneously. No solicitation package will be issued. This notice of intent is not a request for competitive quotations, however, responses received by May 19, 2004, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
