Description

Amendment 4, issued on 5/03/2004, provides the following question received in response to the RFP, and the Government's response. The Government's response is provided for informational purposes only and does not signify any chnage to the requirements. any changes to the requirements will be specifically stated separately. Question 1: There are some clauses within FAR 52.212-4 that our firm cannot agree to; specifically patent indemnifications referenced in "(h)". This is not something that our firm indemnifies for as part of its course of business. Answerr 1: As the certification states under (h) Patent indemnity: "The Contractor shall indemnify the Government and its officers, employees and agents against liability, including costs, for actual or alleged direct or contributory infringement of, or inducement to infringe, any United States or foreign patent, trademark or copyright, arising out of the performance of this contract, provided the Contractor is reasonably notified of such claims and proceedings." This requirement is part of the commercial items certifications and is consistent with customary commercial practices. The Government does not intend to waive its rights in this regard, and therefore this requirement will remain unchanged.
