Description
1. APPLICATIONS ARE INVITED FOR THE POSITION OF STAFF LEGAL ADVISOR, NATO GRADE A-3, POST NUMBER C-0272, ON THE STAFF OF THE SUPREME ALLIED COMMANDER TRANSFORMATION (SACT), NORFOLK, VIRGINIA, USA. THE POSITION IS ANTICIPATED TO BECOME AVAILABLE ON 1 JANUARY 2004 AND IS ADVERTISED SUBJECT TO VALIDATION OF THE JOB DESCRIPTION AND CLASSIFICATION BY THE MANPOWER AUTHORITIES. 2. DUTIES/RESPONSIBILITIES: REPORTS TO THE BRANCH HEAD, LEGAL AFFAIRS. A. UNDER THE GENERAL SUPERVISION OF THE BRANCH HEAD, LEGAL AFFAIRS, THE STAFF LEGAL ADVISOR IS RESPONSIBLE FOR DEALING WITH A BROAD RANGE OF INTERNATIONAL AND FISCAL LEGAL REQUIREMENTS AND MATTERS CONCERNING HQ SACT AND ITS SUBORDINATE NATO AGENCIES AND ACTIVITIES. B. ASSIST THE BRANCH HEAD IN PROVIDING LEGAL OVERSIGHT AND ADVICE/SUPPORT TO SUBORDINATE COMMANDS AND DETACHED LEGAL OFFICES ON BEHALF OF SC TRANSFORMATION IN ORDER TO PROMOTE CONSISTENCY, CONTINUITY AND EFFECTIVE EXECUTION OF ACT'S TRANSFORMATION RESPONSIBILITIES. C. SERVE AS THE PRIMARY LEGAL ADVISOR TO THE HQ SACT BUDGET AND FINANCE DIVISION WITH REGARD TO DEVELOPMENT AND EXECUTION OF INTERNATIONAL CONTRACTS, APPLICATION OF THE NATO AND ACT FINANCIAL REGULATIONS, PROTECTION OF INTELLECTUAL AND TANGIBLE PROPERTY RIGHTS, TRANSFER OF NATO PROPERTY, TECHNOLOGY TRANSFER, IMPACT OF EU TAX, LABOR AND OTHER FISCAL REGULATIONS, REVIEW OF STATEMENTS OF WORK FOR SERVICES BEING CONTRACTED OUT, HANDLING OF CONTRACT APPEALS, REVIEW OF FINANCIAL STATEMENTS, AND DEVELOPMENT OF LEGALLY SOUND, BEST-BUSINESS PRACTICES THROUGHOUT ACT. D. IN SUPPORT OF THE RANGE OF FISCAL FUNCTIONS LISTED ABOVE, DRAFT AND NEGOTIATE IMPLEMENTING AGREEMENTS, INCLUDING MOUS AND EXCHANGES OF LETTERS, BETWEEN HQ SACT AND OTHER NATIONAL AND INTERNATIONAL ORGANIZATIONS. E. PROVIDE LEGAL ANALYSIS OF INTERNATIONAL LAWS AND TREATIES AND OTHER LEGAL SUPPORT WITHIN THE TERRITORY OF ANOTHER NATION. ENSURE SOUND LEGAL ADVICE IS PROVIDED TO ACOS'S AND OTHER MEMBERS OF THE HEADQUARTERS STAFF ON ALL MATTERS PERTAINING TO POLICY, DOCTRINE, RESEARCH AND DEVELOPMENT AND OTHER TRANSFORMATION MATTERS. F. SERVE AS THE LEAD DRAFTER/NEGOTIATOR OF STRATEGIC AND OPERATIONAL-LEVEL ARRANGEMENTS AND OTHER INTERNATIONAL AGREEMENTS ACROSS A WIDE RANGE OF ACT TOPICS AND INTERESTS WITH NATO/PFP AND/OR NON-NATO NATIONS TAILORED FOR TRANSFORMATION INITIATIVES. G. PROVIDE PRIMARY LEGAL SUPPORT TO PROJECTS AND INITIATIVES INVOLVING THE OFFICES OF DACOS REQUIREMENTS AND DACOS FUTURE CAPABILITIES (E.G., POLITICAL/MILITARY PARTNER AND MEDITERRANEAN DIALOGUE COOPERATION PROGRAMS; STRATEGIC CONCEPTS AND POLICY RELATING TO TERRORISM, CONSEQUENCE MANAGEMENT; FORCE PROTECTION, WMD/NBC), AND RESEARCH AND TECHNOLOGY, ESPECIALLY DEVELOPING MOUS AND OTHER AGREEMENTS TO CREATE FORMAL LINKAGES BETWEEN HQ SACT AND THE CLUSTER OF NATO RESEARCH, DEVELOPMENT AND TECHNOLOGY ORGANIZATIONS COMING UNDER ACT OVERSIGHT. H. PREPARE AND PROVIDE BRIEFINGS CONCERNING ALL LEGAL ASPECTS OF TRANSFORMATION, INCLUDING FUTURE CAPABILITIES; RESEARCH AND TECHNOLOGY; FINANCE, RESOURCES AND LOGISTICS; AND ALSO DOCTRINE AND POLICY. I. PROVIDE THE LEGAL EXPERTISE AND CONTINUITY NECESSARY TO CO-ORDINATE, MANAGE AND COMPLETE LONG-TERM BI-SC INITIATIVES. AS DIRECTED, SERVE AS A MEMBER OR TEAM LEADER OF AD HOC LEGAL GROUPS SUPPORTING PAN-NATO INITIATIVES (E.G., THE JOINT WORKING GROUP ON DEFENSE REFORM, JOINT WORKING GROUP ON TERRORISM, AND THE SENIOR CIVIL EMERGENCY PLANNING COMMITTEE). J. AS DIRECTED, REPRESENT ACT AND ITS SUBORDINATE AGENCIES AND INSTITUTIONS AT MEETINGS, SEMINARS, COURSES, CONFERENCES AND SIMILAR FUNCTIONS OF A PROFESSIONAL NATURE AS PART OF THE LEGAL STAFF. AS DIRECTED, PROVIDE TEACHING SUPPORT IN AREAS OF EXPERTISE TO THE NATO SCHOOL (OBERAMMERGAU, GE) AND OTHER NATO-SPONSORED TRAINING PROGRAMS. K. OVERALL, PROVIDE THE HEADQUARTERS WITH LEGAL ANALYSIS OF FISCAL AND LOGISTICS ISSUES, CONTRACTS AND CLAIMS, INTERNATIONAL SUPPORT AND RESOURCE ISSUES AND THE APPLICATION OF INTERNATIONAL LAW, INCLUDING THE DE-CONFLICTION OF NATIONAL AND INTERNATIONAL LAW IN SUPPORT OF THE NATO MISSION, AS WELL AS NATIONAL LAWS OF NATO AND NON-NATO NATIONS AFFECTING ACT'S STATUS, FUNCTIONS, AND MISSION ACCOMPLISHMENT. L. CONDUCT APPROPRIATE LIAISON WITH INTERNATIONAL AND NATIONAL AUTHORITIES TO ACCOMPLISH THE RESPONSIBILITIES LISTED IN THIS SECTION. M. ADDITIONAL DUTIES: PERFORM SUCH OTHER DUTIES AS MAY BE DIRECTED. AS REQUIRED, UNDERTAKE TDY ASSIGNMENTS BOTH WITHIN AND WITHOUT NATO'S BOUNDARIES. AVERAGE TDY PER YEAR WILL BE 12 WEEKS. 3. ESSENTIAL QUALIFICATIONS: A. MUST BE A GRADUATE OF A RECOGNIZED UNIVERSITY LOCATED IN A NATO NATION WITH A LAW DEGREE AND CURRENT LICENSE TO PRACTICE LAW IN A NATO NATION. EXCEPTIONALLY, A UNIVERSITY DEGREE MAY BE SUBSTITUTED BY EQUIVALENT EDUCATION OR EXPERIENCE. B. MINIMUM OF FOUR YEARS OF PROFESSIONAL EXPERIENCE COMMENSURATE WITH THE DUTIES OF THE POSITION, INCLUDING GOVERNMENT/INTERNATIONAL LEGAL STAFF EXPERIENCE. LEGAL EXPERIENCE MUST INCLUDE SOME BACKGROUND IN BUSINESS LAW AND INTERNATIONAL LAW. C. EXPERIENCE DRAFTING, NEGOTIATING AND CONCLUDING INTERNATIONAL AGREEMENTS WITH NATIONAL MILITARY AND/OR GOVERNMENT REPRESENTATIVES. D. POLISHED, PERSUASIVE COMMUNICATOR, ORALLY AND IN WRITING IN ENGLISH, WITH STRONG INTERPERSONAL SKILLS AND DEMONSTRATED CAPACITY TO WORK INDEPENDENTLY, EXERCISE INITIATIVE, AND MAKE APPROPRIATE DECISIONS UNDER CONDITIONS OF UNCERTAINTY AND STRESS. E. PROVEN ABILITY TO WORK INDEPENDENTLY ON POLITICALLY AND FISCALLY SENSITIVE ISSUES. F. MUST BE ELIGIBLE FOR A NATO SECRET SECURITY CLEARANCE. G. MUST HAVE AN EXCELLENT KNOWLEDGE OF ENGLISH (BOTH VERBAL AND WRITTEN) (SLP 4444). H. STANDARD AUTOMATED DATA PROCESSING (ADP) KNOWLEDGE: WORD PROCESSING: ADVANCED KNOWLEDGE SPREADSHEET: WORKING KNOWLEDGE GRAPHICS PRESENTATION: WORKING KNOWLEDGE DATABASE: WORKING KNOWLEDGE 4. DESIRABLE QUALIFICATIONS: A. COMPLETION OF NATO LEGAL ADVISORS' COURSE (NATO SCHOOL, OBERAMMERGAU, GE). B. TRAINING WITH COMPUTERS AND ADVANCED INFORMATION SYSTEMS, INCLUDING MS WORD, MS POWERPOINT AND OUTLOOK. C. EXPERIENCE WORKING WITH TRANSFORMATION ISSUES IN A MILITARY/ GOVERNMENT ENVIRONMENT. D. PREVIOUS EXPERIENCE IN A NATO LEGAL OFFICE DEALING WITH INTERNATIONAL LAW ISSUES, INCLUDING TREATIES AND STATUS OF FORCES AGREEMENTS WITH FOREIGN MILITARY ORGANIZATIONS AND GOVERNMENT OFFICIALS. E. FAMILIARITY WITH THE LEGAL, FISCAL AND OPERATIONAL DIMENSIONS OF MULTINATIONAL AGREEMENTS AND NATO DOCUMENTS AT A STRATEGIC LEVEL, ESPECIALLY WITHIN THE FRAMEWORK OF INTERNATIONAL AND PRIVATE ORGANIZATIONS, INCLUDING NATIONAL MILITARY COMPONENTS AND THE POLITICAL STRUCTURE AND PROCESS OF NATO AND NON-NATO NATIONS. F. FORMER MILITARY TRAINING/EXPERIENCE AND KNOWLEDGE OF THE NATO MILITARY COMMAND STRUCTURE, ORGANIZATION AND MISSION. G. EXPERIENCE WITH FISCAL/CONTRACT LAWS AND PRACTICES APPLICABLE TO INTERNATIONAL ORGANIZATIONS. H. EXPERIENCE AS INSTRUCTOR/FACILITATOR OF NATO COURSES, SEMINARS, AND/OR EXERCISES. 5. PERSONAL ATTRIBUTES: A. ABILITY TO WORK HARMONIOUSLY IN A MULTINATIONAL ENVIRONMENT, WHILE REPRESENTING AND PROJECTING HQ SACT POSITIONS IN A FIRM BUT TACTFUL MANNER. B. PROBLEM-SOLVING CREATIVITY AND JUDGMENT UNDER STRESSFUL CONDITIONS AND IN THE NUMEROUS INSTANCES WHEN PRECEDENTS ARE UNAVAILABLE OR INAPPROPRIATE. C. WILLINGNESS AND ABILITY TO TRAVEL EXTENSIVELY IN SUPPORT OF THE LISTED DUTIES. INCUMBENT CAN EXPECT TO BE ABSENT ON OFFICIAL TRAVEL APPROXIMATELY 12 WEEKS IN A YEAR. 6. MANAGERIAL RESPONSIBILITIES: INCUMBENT HAS NO FULL-TIME SUBORDINATES, BUT RATHER PROVIDES BOTH GENERAL AND SPECIALIZED LEGAL SERVICES TO HQ SACT AND SUBORDINATE ACTIVITIES. SERVES IN CONSULTATIVE ROLE THROUGHOUT ACT COMMUNITY IN AREAS OF SPECIAL LEGAL EXPERTISE. MANAGES AND COORDINATES LEGAL EXPERTISE WITHIN HIS/HER PURVIEW WITH SHAPE AND NATO HQ PERSONNEL IN SUPPORT OF BI-SC INITIATIVES AND HQ SACT ACTIVITIES. SERVES AS TEAM LEADER OR MEMBER OF AD HOC BI-SC LEGAL GROUPS PROVIDING LEGAL SUPPORT TO NATO HQ WORKING GROUPS ENGAGED IN PAN-NATO INITIATIVES. 7. PROFESSIONAL CONTACTS: NORMALLY INTERACTS WITH MEMBERS OF THE HQ SACT SENIOR STAFF, UP TO AND INCLUDING THE COMMAND GROUP. CONTACTS OUTSIDE OF ACT ARE PRINCIPALLY WITH LEGAL, POLICY AND FINANCIAL OFFICIALS IN OTHER NATO HEADQUARTERS AND BODIES (UP TO THE ASSISTANT SECRETARY GENERAL LEVEL), SENIOR OFFICIALS OF VARIOUS MINISTRIES IN COUNTRIES HOSTING ACT SUBORDINATE ORGANIZATIONS. WITHIN THE NATO AND PFP CONTEXT, OFTEN INVOLVED IN FORMAL NEGOTIATIONS WITH SENIOR MINISTRY-LEVEL OFFICIALS. 8. CONTRIBUTION TO OBJECTIVES: SERVES AS ACT'S PRIMARY EXPERT AND RESERVOIR OF LEGAL EXPERTISE IN DEVELOPING INTERNATIONAL, BI-SC, AND INTRA-ACT AGREEMENTS TO SUPPORT TRANSFORMATION. AS OF 01 JANUARY 2003 IS U.S. DOLLARS 6106.00 TO WHICH RELEVANT ALLOWANCES WILL BE ADDED. 11.
