Description
This is for a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12,6, as supplemental with additional information included in this notice. The announcement constitutes the only solicitation; a written solicitation will not be issued. This solicitation is being issued as a Request for Quotation (RFQ) #857440 is being conducted as 100% Small Business set-aside under the procedures of Part 12 and 13, (test program). This solicitation is being conducted under the Simplified Acquisition Procedures (SAP). The North American Industry Classification System (NAIC) Code for this acquisition is 334220. The standard size for NAICS code is 750 employees. The solicitation will be distributed solely through the General Services Administration’s Federal Business Opportunities web site http://fedbizops.gov/. The site provides downloading instructions. All future information about this acquisition including solicitation amendments, will also be distributed solely through this site. Interested parties are responsible for monitoring this site to ensure that they have the most up-to-date information about this acquisition. The Federal Bureau of Investigation (FBI) intends to solicit and negotiate on a sole source basis with Audio Processing Technology 625 Sunset Blvd., Los Angeles, CA. 90028,for the purchase of ten (10) Worldnet Rio V.35 audio codec equipment with apt-X, which allows 12Kb/sec. coded audio to be transmitted over leased digital telephone circuits. The proposed contract action is for equipment for which the government intends to solicit and negotiate with one source under the authority of FAR 6.302 and will result in a Firm Fixed Price contract. This not a request for competitive quotes. However, all compliant quotes received within (15) fifteen days after date of publication will be considered by the government. These items are proprietary to Audio Processing Technologies and are required for continuity with existing systems. Delivery of the items shall be 30 days after receipt of order. The delivery shall be FOB Destination to FBI, Quantico, VA. All quotes shall be submitted to the attention of Mr. Duane McClary, Contracting Officer, Engineering Research Facility, RFQ 857440, Building 27958a, Quantico, Virginia 22135, by 2:00 PM, EDT, 9/16/2003. The facsimile number is (703) 632-6103. The RFQ incorporates provisions and clauses that are in effect thorough Federal Acquisition Circular 2001-15. FAR Clause 52.212-1, Instructions to Offerors (July 2003), FAR Clauses 52-212-4, Contract Terms and Conditions (FEB 2002) and addendums are incorporated into this solicitation. Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes and Executive Orders (Jun 2003), Subsection (a), (b), (d) and (e) apply. Addendum to 52.212-1 Modify: (b) Submission from offer(s) is to read as follows: “Submit signed and dated offer(s)to the attention of Mr. Duane K. McClary, Contracting Officer, at FBI,RFQ-857440, Engineering Research Facility, Building 27958a, Quantico, VA 22135. It is encouraged that you facsimile your quote to (703) 632-6103, with the original to follow via mail. Clause 52.212-4, add 52.233-2-Service of Protest (AUG 1996; 52-215-5 Facsimile Proposals (OCT 1997) Department of Justice (DOJ), Justice Acquisition Regulation (JAR)Clauses, 2852.233-70 Protests Filed Directly with the Department of Justice (JAN 1998); and 2852.201-70 Contracting Officers Technical Representative (COTR) (JAN 1985). Mr. Anthony Baumann, Chief Contracting Officer, Federal Bureau of Investigation, 935 Pennsylvania Ave., NW Washington, DC 20535-0001, shall serve as the FBI’s Contact in accordance with 52-233-3 Protest After Award. Addendum to Clause 52-252-5 Authorized Deviations in clauses (APR 1984), is incorporated by reference and applies to FAR 9.104-1. Clause 52.212-3, Offeror Representations and Certifications (Jun 2003) and applies to this acquisition. Each offer shall include a completed copy of 52.212-3 with their quote. Clause 52-212-2 Evaluation-Commercial Item (JAN 1999) is incorporated by reference and applies to this acquisition. ADDENDUM to 52.212-2 (a)–Award will be based on best price to the government. The evaluation of this RFQ will be in accordance with Part 12, 13, and 15 of the FAR. The following factor shall be used to evaluate offers: Price. Offerors must acquaint themselves with the new regulations concerning Commercial Item acquisition contained in FAR Subpart 12 and must ensure that all Representations and Certifications (located on the Internet) are executed and returned as required in this synopsis/solicitation.
