NAICS Code: 524298 THIS IS A SOURCES SOUGHT SYNOPSIS FOR WRITTEN INFORMATION ONLY. THIS IS NOT A SOLICITATION ANNOUNCEMENT FOR PROPOSALS, AND NO CONTRACT WILL BE AWARDED FROM THIS ANNOUNCEMENT. The Environmental Protection Agency's (EPA) Office of Site Remediation Enforcement (OSRE) in the Office of Enforcement and Compliance Assurance (OECA) is performing "market research" to determine potential sources in preparation for a future procurement to assist OSRE and regional EPA offices with the following: 1) support with analysis of potential insurance policy issues related to Superfund settlement and cases; 2) legal research on state law issues regarding insurance; 3) assist in the review of insurance policies that may be used to fund a settlement with EPA; and 4) assist in the evaluation of any potential recovery of funds from insurance policies held by potentially responsible parties (PRP). The successful contractor shall assist EPA with issues including but not limited to: 1) researching and analyzing state law issues relating to insurance; 2) advising EPA in negotiating insurance policy terms in Superfund settlements including, but not limited to, the terms and conditions of cost cap, finite risk, pollution legal liability and similar insurance policies, and ensuring that EPA's interest as a coinsured or additional insured party under such policies are adequately protected; 3) reviewing insurance policies held by potentially responsible parties in order to: a) identify the insured party and insurer(s), the type of insurance policy, dates of coverage, type of loss/damaged covered, and relevant exclusions and endorsements; and b) evaluate the likelihood and amount of any potential recovery based on site-specific facts, policy exclusions, relevant state law, etc.; and 4) providing other litigation support activities. This work requires personnel with insurance expertise in this industry. Firms should be aware that quick turnaround technical and analytical support of multiple reports is sometimes necessary to support the Agency's work on Superfund litigation and settlements to meet court-mandated, statutory and other deadlines. The successful contractor shall not be: 1) presently employed by, retained by, or otherwise doing work for an insurance company, particularly an insurance company that is either (a) involved in litigation concerning insurance coverage for environmental claims, or (b) involved in the business of selling new insurance policies covering such matters as environmental liabilities, cost caps for cleanup, and/or annuity funding of long-term remedies; 2) presently employed by, retained by, or otherwise doing work for a private company with respect to environmental insurance issues, as such companies are or could be reasonably expected to become a PRP at a CERCLA site; 3) an insurance broker or similar that could directly profit from the placement of environmental insurance policies to or for the benefit of a PRP or the United States; and 4) have legal or fiduciary obligations to existing clients that would impair its ability to render full, fair, accurate, and unbiased advice to the United States on insurance and insurance-related issues. Any interested firm or company should submit a capability statement which demonstrates the firm or company's ability and approach for accomplishing the work described above. In the capabilities statement, the company should provide their size status for the subject NAICS code (i.e., large, small, woman-owned, 8(a) and/ or disabled veterans-owned concern). The applicable NAICS code is 524298, with a corresponding size standard of $6 Million. IN ADDITION, THE GOVERNMENT PREFERS TO MAKE ANY SUBSEQUENT AWARD TO A CONTRACTOR WITH A GENERAL SERVICES ADMINISTRATION (GSA) FEDERAL SUPPLY SERVICE (FSS) MULTIPLE AWARD SCHEDULE (MAS) CONTRACT.
