- NASA/JSC has a requirement for 40, 22-bit USB data acquisition units with 16 digital I/O & 2 frequency/pulse input channels. NASA/JSC intends to purchase the items from IOtech. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) as contemplated by the provisions of FAR 6.302-1 which states, full and open competition need not be provided for when "Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in - substantial duplication of cost to the Government that is not expected to be recovered through competition". In this case the Advanced Resistive Exercise Device (ARED) project team has previously selected this particular model as final flight hardware design. Initial units have been purchased to build a prototype system and now the project requires purchase of all flight units. The Government intends to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:30 p.m. local time on August 27, 2003. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer which shall be considered by the agency. An Ombudsman has been appointed.
