Description
The Naval Surface Warfare Center, Dahlgren Division (NSWCDD) intends to procure on a sole-source basis from Green Hills Software, Inc., 2708 Alternate 19 North, Palm Harbor FL, 34683, software support and updates for proprietary AdaMULTI software. Green Hills Software, Inc. is the developer, designer, and manufacturer of this software and hold proprietary rights in data in providing support. The North American Industry Classification System Code is 541511 with a size standard of $18.0 million. The contract shall be a firm fixed price contract and shall have a one-year base period and a one year option period. FOB destination shall apply. The following is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Part 12 and in accordance with Simplified Acquisition Procedures, FAR 13.5-Test Program for Certain Commercial Items, and sup plemental information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is N00178-03-R-1106 and is a request for proposal. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-15. All interested parties shall indicate their interest and capability with their fax quote at (540) 653-7088, which shall be considered by Naval Surface Warfare Center, Dahlgren Division, 17320 Dahlgren Road, Dahlgren, VA 22448-5100. All updates and documentation shall be shipped FOB Destination to the Receiving Officer, Building 125, Naval Surface Warfare Center, Dahlgren Division, 17320 Dahlgren Road, Dahlgren, VA 22448-5100, Mark for: User Name and Code. The following specifications are here as follows: C.1 Support shall include unlimited telephone support Monday through Friday, excluding weekends and government holidays from 8am through 5pm local Dahlgren Time. C.2 The Contractor shall provide software updates as released to each of the identified custodians at the addresses indicated. C.3 Additions and deletions shall be prorated by dividing the yearly contract amount by 12 and multiplying by the number of months. FAR 52.212-1, Instructions to Offerors-Commercial Items and the provisions FAR 52.212.2, Evaluation-Commercial Items, apply to this solicitation and are hereby incorporated by reference. Offerors shall include a completed copy of the provisions at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items with its offer. The provision at FAR 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition. FAR 52.2 17-5, Evaluation of Options applies to this acquisition. The provision at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, Subparagraphs (a), (b) (1), (11), (12), (13), (14), (15), (16), (d), and (e) apply to this acquisition and are hereby incorporated by reference. The provision at DFAR 252.212-7000, Offeror representations and certifications-Commercial items applies. The provisions at DFAR 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisition of Commercial Items is applicable with the following provisions of subparagraph (b) thereof indicated as applicable: DFARS 252.205-7000, 252.225-7007, 252.225-7012, 252.227-7015, 252.227-7037, 252.243-7002, and 252.247-7024. The following DFARS provisions are applicable to this acquisition: DFAR 252.204-7004 Required Central Contractor Registration, DFAR 252.225-7017 Prohibition on Award to Companies Owned by the Peoples Republic of China. The following full text clause applies: Date/Time Processing Requirement ? Information Technology (Jun 2000) (a) All information technology (IT), whether commercial or noncommercial, delivered under this contract that will be required to perform date/time processing involving dates subsequent to December 31, 1999, shall be year 2000 compliant if properly installed, operated, and maintained in accordance with the contract specifications and applicable documentation. If the contract requires that specific deliverables operate together as a system, this warranty shall apply to those deliverables as a system. (b) Information Technology or IT, as used in this requirement, means information technology as that term is defined at FAR 2.1 01, and further including those items that would otherwise be excluded by paragraph (c) of that definition. Year 2000 compliant (as defined at FAR 39.002) means that the IT accurately processes date/time data (including, but not limited to, calculation, comparing, and sequencing) from, into, and between the twentieth and twenty-first centuries, and the years1999 and 2000 and leap year calculations, to the extent that other IT, used in combination with the IT being delivered, properly exchanges date/time data with it. The proper exchange of date/time data shall be in accordance with the interface requirements specification(s) of the contract. (c) For line item deliverables which are commercial items (as defined at FAR 2.101), and which include commercial IT, the terms and conditions of the standard commercial warranty covering such commercial IT shall apply in addition to, an d to the extent such terms and conditions are consistent with, this warranty. Any applicable commercial warranty shall be incorporated into this contract by attachment. (d) Notwithstanding any provision to the contrary in other warranty requirement(s) of this contract, or in the absence of any such warranty requirement(s), the remedies available to the Government under this warranty shall include those provided in the Inspection clause(s) of this contract. Nothing in this warranty shall be construed to limit any rights or remedies the Government may otherwise have under this contract. (e) Unless specified elsewhere in the contract, the Contractor will also deliver to the Government a report summarizing any Year 2000 compliance testing that was performed, and the results thereof. (f) The remedies available to the Government for noncompliance with this requirement shall rema in available until 31 January 2001, or one hundred eighty (180) days after acceptance of the last deliverable IT item under contract (including any option exercised hereunder), whichever is later. This procurement is DO priority rated.
