Description
NOTICE OF PROPOSED CONTRACT ACTION. It is the Government's intent to negotiate a FAR Part 15 award on a sole source basis for a Common Low Observable Autorouter (CLOAR) Software maintenance requirement. The existing CLOAR Software was developed by BAE Systems, Mission Solutions Inc., San Diego, CA and includes approximately 7% of CLOAR proprietary data within the software. If the proprietary code is removed the software will be unable to compile and link. Therefore, it will not be able to generate a functional executable. The F-117A program requires correction of CLOAR software shortfalls encountered during Operation Iraqi Freedom (OIF). The CLOAR software shall incorporate the Change Requests (CRs) generated during OIF to meet the needs of the F-117A. All software shall be fully integrated with the latest Mission Planning Systems Core software. The Government believes that BAE Systems, Mission Solutions Inc, San Diego CA is the only qualified source that can quickly incorporate the fixes to the CLOAR software that the F-117A program requires. BAE Systems is the only organization that can provide uninterrupted service to ESC and the war fighter. The CLOAR software, while not difficult to learn to use, is significantly complex in architecture and algorithmic code design. Only BAE Systems possess the required in-depth knowledge of the algorithms and the inter-relationships and linkage between elements of the code and can provide software changes without breakage to collateral code and functions. A contracting vehicle is available with BAE Systems that can be utilized without significant delays. From a technical standpoint, it would take an estimated 2 years and significant duplication of costs for another contractor to come up to speed on the capability that CLOAR provides to the war fighter. CLOAR contractor personnel hold Top Secret SAR clearances required for support to Low Observable aircraft (B-2, F117, JASSM, JSF, and F-22). Statutory authority is 10 USC 2304 (c)(1) as implemented by FAR 6.302-1(a)(2)(i): "only one responsible source". This notice does not constitute an RFP nor should it be construed as a Government commitment. It does not restrict the Government as to the ultimate acquisition approach. Offerors are reminded and cautioned that only Contracting Officers are legally authorized to commit the Government.
