Description
MODIFICATION: This modification corrects the authority used for other than full and open competition from Maintaining an essential capability to Services available from only one or a limited number of responsible sources. The Missile Defense Agency (MDA) has identified a requirement for research and engineering support involving the following areas of expertise: applied research, analysis, evaluation, maturation, integration, test and demonstration of leading edge guidance, navigation, and control (GN&C) technologies including their associated sensors, information systems, and modeling and simulation capabilities in support of the MDA Ballistic Missile Defense (BMD) Program. The Government proposes to award an indefinite delivery indefinite quantity (IDIQ) contract to the Charles Stark Draper Laboratory to provide technical research and engineering support for technology integration, demonstration, exercise, test and evaluation activities to the MDA and its various program elements and technology programs. The proposed contract action is for supplies or services, which the Government intends to solicit and negotiate with Draper Laboratory under the authority of FAR 6.302-1(a)(2)Services required by the agency are available from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, however, additional IDIQ contracts may be awarded to other independent labs that respond to this announcement. Interested sources may identify their interest and capability to respond to the requirement. SEE NOTE 22 Any offeror that responds to this announcement and wishes to submit a proposal must complete an Organizational Conflict of Interest (OCI) Analysis/Disclosure Form in accordance with the OCI clause which shall be contained within the basic contract document. In accordance with the requirements of the OCI clause, the contractor shall not provide supplies or services on any other MDA or MDA related contract as a prime or subcontractor except for work on the contract awarded as a result of a Broad Agency Announcement (BAA) and only then by receiving the written permission of the Contracting Officer of the current IDIQ contract for each particular BAA. In addition, the general rules cited within the Federal Acquisition Regulation (FAR) Subpart 9.505-1 through 9.505-4 prescribe limitations on contracting as the means of avoiding, neutralizing, or mitigating organizational conflicts of interest that might otherwise exist, apply not only to this acquisition, but also to each task order issued there under.
