Description
This is a combined synopsis/solicitation for supply contracts for commercial items in accordance with the format in Subpart 12.6, as supplemented with the additional information included in this notice. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITTION; PROPOSALS ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. The solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-23 effective February 20, 2001. The solicitation number is MT642-03 and this is a Request for Proposal. This acquisition is unrestricted. The North American Industry Classification System (NAICS) code is 331221? for Various Steels- Sheet, Coil, Angle, and Tubing designated by ?LOTS? for a specific type of steel and location. Federal Prison Industries, Inc. intends to enter into firm, fixed price requirements type contracts for a period of performance of one year at the following two UNICOR locations: UNICOR Lewisburg, Pennsylvania and UNICOR El Reno, Oklahoma. Each LOT will be awarded on an ?All or None Basis?. There are five LOTS within this proposal. The LOTS are divided as follows: LOT 1: Angle Steel for UNICOR Lewisburg, PA- Line items 1 and 2; LOT 2: Coil and Sheet Steel for UNICOR Lewisburg, PA-Line items 3 thru 36; LOT 3: Angle Steel for UNICOR El Reno, OK- Line items 37 thru 44; LOT 4: Sheet Steel for UNICOR El Reno, OK-Line items 45 thru 56; and LOT 5: Tubing Steel for UNICOR El Reno, OK-Line items 57 thru 81. The small business standard size is 1000 employees. During the event, prices will be submitted for the entire ?LOT?. Award will be on an ?All or None Basis? by LOT. The line item quantities specified in the solicitation are estimates only; and shall not obligate the Government. Orders may be issued from date of contract award through one year thereafter (Period of Performance). The contractor will only deliver items and quantities specified by individual delivery orders placed by authorized personnel either at the specific factory location and /or Central Office in Washington, DC with the exception of the Contracting Officer?s Technical Representative (COTR). The Contracting Officer?s Technical Representative (COTR) for Lewisburg, Pennsylvania is Mr. Dale Hoot, Telephone: 570/523-1251 Ext.398. The Contracting Officer?s Technical Representative for El Reno, Oklahoma is Ms. Nancy Evans, Telephone: 405/262-4875 Ext. 369. Prices will be FOB Destination. Deliveries will be as follows for Lewisburg, Pennsylvania: Monday through Friday, excluding weekends, Federal Holidays, and institution emergencies. Delivery address: UNICOR Lewisburg, (PO Box 1000), William Penn Road, Lewisburg, Pennsylvania. Delivery Hours: 8:00AM to 1:30PM, no unloading between 10:30AM and 11:30. Variations in quantity per each delivery order are plus 5% / minus 5% for UNICOR Lewisburg. Items are due to UNICOR within the following calendar days after receipt of order: 14 calendar days for UNICOR Lewisburg. Delivery order limitations for Sheet steel are: a minimum of 25 each per line item for UNICOR Lewisburg. The maximum quantities per order are 50 each per each line item or any combination of items in excess of 1500 each. Delivery order limitations for Coil steel are: a minimum of 1000 lbs per line item. The maximum quantities per order are 250 lbs or any combination of items in excess of 1,000,000 lbs. Deliveries will be as follows for El Reno, Oklahoma: Deliveries will be Monday thru Friday excluding weekends, Federal Holidays, and institution emergencies. Delivery address: UNICOR El Reno, PO Box 1000, Hwy, 66 W, El Reno, Oklahoma 73036. Delivery Hours: 8:00 AM to 3:00 PM. Variations in quantities per each delivery order are plus +10/ minus-0 %. Items are due to UNICOR El Reno, OK within 14 calendar days after receipt of order. Delivery order limitations for Angle Steel are: a minimum of 50 each per line item for UNICOR El Reno. The maximum quantities per order are 3500 each per line item or any combination of items in excess of 47,500 ft and 8000 each. Delivery order limitations for Sheet Steel are: a minimum of 50 each per line for El Reno. The maximum quantities per order are 3500 each per line item or any combination of items in excess of 7000 each. Delivery order limitations for Tubing Steel are: a minimum of 50 each per line item for El Reno. The maximum quantities per order are 3500 each or any combination in excess of 16,500 ft. and 56,625 each. The contractor shall not be required to make any deliveries under these contracts after 14 calendar days from contract expiration date. The Contractor is required to submit a Certificate of Conformance with each order. The proposal will be evaluated by the following Best Value Criteria: Price, Past Performance, Technical, and Delivery. UNICOR intends on awarding each LOT on an ?All or None Basis?. Proposals are due in this office no later than Thursday, May 15, 2003 at 2:00 PM ET. All required documentation is due by the closing date and time specified WITH THE EXCEPTION OF THE PRICES. The offeror is required to provide past performance information for the same or similar product from three of the most recent contracts, include the following information: Company name, contact person, telephone number, product/service provided, and dollar value of the contract. Offerors will submit signed and dated offers on Standard Form SF 1449 or Company letterhead stationary along with required certifications and representations, ACH Form. Facsimile proposals are acceptable at 202/305-7353 to the attention of Alice Calabro, Contracting Officer. Offers must be received no later than Thursday, May 15, 2003 at 2:00PM ET. The proposal must include the company name, address, telephone number, technical description of the items being offered in sufficient detail to evaluate in compliance with the requirements in the solicitation, and a completed copy of Representation and Certifications?Commercial Items and acknowledge all amendments, if applicable. Offeror will hold prices firm for 60 calendar days from the bidding event date. If the offer is not submitted on a Standard Form SF 1449, submit the proposal on Company letterhead, with a statement specifying agreement with the terms and conditions stated in the solicitation. Offers that fail to furnish required representation and certifications or reject the terms and conditions of the solicitation may be excluded from consideration. All responsible/responsive contractors will be considered for award. Due to electronic payment procedures, all vendors must supply the company ACH information and TIN number. A completed ACH form is required prior to award. A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer shall result in a binding contract without further action by either party. Before the offer specified expiration date, the Government may accept an offer or part of an offer after its receipt unless a written notice or withdrawal is received before award. The offeror must specify business size. The solicitation package with the detailed specifications along with the Procurement forms and further information about the CBE will be made available at the UNICOR website: www.unicor.gov/procurement. Following is information specific to the Competitive Bidding Event: I. GENERAL For the purpose of expediting price related discussions, the Contracting Officer has opted to conduct a competitive, anonymous, on-line reverse auction using the UNICOR Quicksource E-Sourcing website. UNICOR refers to such an auction as a Competitive Bidding Event (?CBE?). For the sake of consistency and to avoid confusion, this solicitation will similarly refer to such auction as a CBE. However, use of this phrase shall not be construed to imply that this solicitation is being conducted under the procedures set forth at FAR Part 14, Sealed Bidding. Rather, this solicitation is being conducted under the procedures set forth at FAR Part 12, Acquisition of Commercial Items, in conjunction with the policies and procedures for solicitation, evaluation, and award prescribed in FAR Part 15, Contracting by Negotiation. During the CBE, Offerors will provide pricing through submission of electronic offers via the UNICOR Quicksource website. The primary pricing competition for this solicitation will be through the online reverse auction. Qualified Offerors will have the ability to submit revised pricing during the CBE in response to prices submitted by other offerors. The identity of offerors will not be revealed to each other during the CBE. The final such revision during the CBE will be considered the Offeror?s final proposal. The Contracting Officer reserves the right to conduct verbal or written discussions with respect to factors other than price with the Offerors at anytime prior to award. Only offerors that have been determined qualified will be permitted to participate in the CBE. Offerors who are deemed qualified will be notified by the Contracting Officer. All qualified Offerors must Call:877/687-2320 to schedule a mandatory Quicksource training. Offerors are NOT to submit pricing with their initial proposals. Offerors should submit all required information, except for pricing, by the deadline for submissions on May 15, 2003 at 2:00PM ET. Pricing will only be accepted through the CBE. II. REVERSE AUCTION a. During the CBE, Offerors may revise their initial pricing proposal through submission of electronic offers during the anonymous CBE. This CBE shall constitute discussions with the Offerors. The final such revision during the CBE will be considered the Offeror?s Final Proposal Revision (FPR). b. The Contracting Officer reserves the right to suspend or cancel the CBE at any time. If the Contracting Officer cancels the CBE, Final Proposal Revisions will be requested by an amendment to the solicitation. c. Notwithstanding FAR 52.215-5, Offerors will submit revised pricing only through the online UNICOR QuickSource Site. Offerors will not submit revised pricing via any other mechanism including but not limited to post, courier, fax, E-mail, or orally unless specifically requested by the Contracting Officer. d. The CBE bidding period shall be set by the Contracting Officer as indicated in Section III, paragraph (a). Electronic offers shall be submitted by Offerors during the CBE period. If a market leading offer is submitted within the last minute of the time period, the time period shall be extended for two additional minute(s) beyond the scheduled closing. The end of the last minute during which revised offers are permitted as addressed in this paragraph, shall be considered the end of the CBE bidding period. e. Any Offeror experiencing difficulties during a CBE must notify the UNICOR QuickSource Helpdesk immediately at T: 877/687-2320. ?Difficulties? include any event or problem, which interferes with the Offeror?s ability to participate in the CBE and may include, but is not limited to: data entry errors, software problems, or hardware problems. Offerors will have five minutes after a Lot goes into ?Pending? status to notify the UNICOR QuickSource Helpdesk of any problems. If the Contracting Officer judges that any Offeror has been disadvantaged by a problem, they may address the problem and return the Lot to ?Open? status. f. Any and all Offeror contact with FreeMarkets, the provider of the UNICOR QuickSource website, is for the sole purpose of facilitating the CBE and shall not be considered discussions with the Offeror within the meaning of FAR Part 15. g. For purposes of FAR 52.203-2, and in accordance with subparagraph (c) thereof, submission of a proposal by the Offeror shall be considered certification by the Offeror that the only knowing disclosure by the Offeror of its prices to any other Offeror will be during the CBE. The Offeror further certifies that disclosure by the Offeror of its prices during the CBE shall not be for the purposes of restricting competition. h. UNICOR reserves the right to reject any or all quotes received for any or all lots. III. CBE PARAMETERS a. The date of the Competitive Bidding Event is May 29, 2003. The Competitive Bidding Event shall be MT642-03. There will be 5 lots. The bid opening time shall commence at 10:00 am Eastern Daylight Time. The bidding period time shall expire at 10:30 am EDT unless a quote is submitted for Lot 1 within the two minute of the bid opening time period for Lot 1. If a quote is submitted within the last minute of the bidding period for either lot, the previously scheduled bid ending period for that lot shall be extended for an additional minute beyond the scheduled expiration time (provided the quote was the lowest quote received). The bidding period will continue to be extended for additional one-minute periods as long as a lower quote is submitted within the last minute. The bidding period for Lot 2 shall expire no less than seven (7) minutes after the actual expiration of the bidding period for Lot 1. The exact expiration times for each lot will depend on the number of overtime periods and will be controlled and displayed during the event via the BidWare software. b. Only qualified Offerors will be permitted to submit electronic quotes through the UNICOR QuickSource Site. Quotes that Offerors submit through the UNICOR QuickSource Site are legally binding quotations without qualification. Quotes may not be cancelled or withdrawn except for data entry errors. Contractors must submit their quotes through the online bidding mechanism and not through any other mechanism including but not limited to post, courier, fax, e-mail, or orally. c. In changing their quote prices, Offerors must change the amount of their quote by at least 0.50% and cannot place bids within 0.50% of the market leading quote. d. In order to place a market leading quote, an Offeror must submit an offer that is lower than the current market leading quote but at least 0.50%. e. In changing their quote prices, Offerors are not allowed to lower their quotes by more than 50 % from their previous quote. If an Offeror wishes to change its quote price by more than this amount, the Offeror must submit successive quotes until the Offeror reaches the desired bid amount. f. There will be 5 lots, as specified above. Prices submitted during the CBE must be aggregate extended prices for each lot in its entirety based on the estimated maximum quantities listed in this solicitation. The Contracting officer will provide each offeror with a detailed cost breakdown worksheet that offerors must use to submit their line item pricing after the CBE has concluded. In each offeror?s submitted cost breakdown worksheets, all aggregate extended prices must correspond to the lowest aggregate extended prices entered by the offeror during the CBE.
