Description
(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will NOT be issued. (ii) The solicitation number is EDOOCR-03-000027 and is issued as a Request for Quotes. (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 12, 01/24/03. (iv) This solicitation is full and open. It is issued under the NAICS code of 541910. (vi) The base period of performance is anticipated to be from 3/15/03 - 9/30/03 with two one-year options. Should ED choose to exercise Option Period I, the Period of Performance would be 10/1/03 - 9/30/04. Should ED choose to exercise Option Period II, the Period of Performance would be 10/1/04 - 9/30/05. (vii) The provision at 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. (viii) The provision at 52.212-2, Evaluation Commercial items is applicable to this acquisition. The list of the evaluation criteria can be found below. Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items, with its Quote. (ix) The clause at 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. (x) The clause 52.212-5, Contract Terms and Conditions required to Implement statutes Or Executive Orders - Commercial Items, applies to this acquisition. (xi) Quotes are due on or before 2:00 PM on 3/10/03. (xii) Please contact Pamela Bone at 202/260-0183 if you have any questions regarding this solicitation. Questions must be submitted in writing by email (Pamela.Bone@ed.gov) or fax (202/260-0526) on or before 12:00 PM noon on 3/04/03. The requirements are as follows: US Department of Education, Office for Civil Rights, Legal Research Service FY 2003, Period of Performance March 1, 2003 - September 30, 2003. Summary: The US Department of Education, Office for Civil Rights (OCR) is based in Washington DC and has offices in Chicago, Denver, Dallas, Philadelphia, New York, Boston, Atlanta, San Francisco, Kansas City, Seattle, and Cleveland. This acquisition will be accomplished by posting the combined synopsis/solicitation on FedBizOpps. Specifically, OCR will be selecting a firm from offerers using FedBizOpps who submit quotes for the use of on-line legal research service and case retrieval services. The service must be an on-line, full text, fully interactive computer assisted legal research service, consisting of judicial opinions, statutes, regulations, and other related information as outlined in this synopsis. OCR requests that these firms provide detailed information about the content of their services, pricing structure, and other related information as outlined below. Vendor Selection Criteria: OCR will select a firm based on the factors categorized in this synopsis, including (in priority order) price, comprehensiveness of the database, accessibility of the data, customer service, training and Past Performance. Pricing Structure: The price listing must be clear, it must state if there is a flat monthly rate and if there are additional separate price(s) for other certain services or databases. Databases that are listed in separate groups in the following section must be priced separately. The proposal must also indicate the number of hours of usage that are covered with the pricing plan and any additional costs for extra hours of usage if applicable. The purchase order will be awarded as a Firm Fixed Price Purchase Order. The period of performance for this purchase order will be one base year period with two one-year options. ED may decide to exercise the option years at its sole discretion. Should ED choose to exercise the options, the contractor will be notified within 30 days before the end of the purchase order. Offerors quotes must contain complete cost information for both option periods in addition to the base period. The option periods will be evaluated to determine the best value to the Government. Databases: The contractor must provide a list and description of all databases included with its service, along with the coverage (dates available) for each database. Required Databases: The databases listed below are required to be included with the base legal research service. a) Law Reviews (the vendor must list what is available); b) US Code Annotated; c) Code of Federal Regulations; d) Federal Register; e) Office of Hearings & Appeals Decisions; f) Administrative Law Judge (ALJ) Decisions; g) State Education Codes, Statutes, Regulations and Judicial Decisions; h) Legislative History (Bill Tracking); i) Civil Rights Reviewing Authority Decisions. Additional Databases: All offerors must specify the additional costs to be incurred by OCR for access to the following seven groups of databases. These items must be presented and priced separately from the base purchase order. For each group, all offerors must include a brief description and the dates available for the databases and/or publications. OCR will have an option to include or exclude these items with the legal research service award. Group 1: National Disability Law Reporter (NDLR) and Individuals with Disabilities Education Law Report (IDELR). Group 2: Chronicle of Higher Education. Group 3: Harvard Civil Rights Project. Group 4: Full text of all of the major/key city newswire/newspapers. Group 5: Business publications and related databases. Group 6: Medical journals. Group 7: Other Education and/or Civil Rights Publications or Databases. All offerors must provide a list of all Education and Civil Rights related databases that could be made available through the online legal research service. This list must contain a description of the databases, the dates available, and any additional costs that would be incurred by OCR. Each item should be priced separately. OCR may choose to include or exclude these services from the legal research service award. Customer Service: Training: All offerors must describe, in detail, the type of training that will be available to users. Training should be available to enhance users' efficiency and to train users how to use the system in a cost effective manner. OCR requires on-site training. The offerors must describe the extent of the onsite training, including number of hours, frequency, scheduling availability and flexibility of trainers for training period, and topic areas covered during the training. If the vendor offers training in its own training facilities, a list of locations of the facilities and the availability of those facilities to OCR users is required. Help line: OCR requires that complete customer service/help desk service is available to all users. All offerors must include the type of help line services, the hours of availability and the extent of the service. The offerors must also indicate accessibility of this service to users with disabilities. Intuitiveness/Ease of Use: The service must be user friendly, easy to access, and easy to use. All offerors must provide details about the functionality of the product in these areas. The offerors must describe how the search command works and how quickly a search can be accomplished. Accessibility: All offerors must describe, in detail, the accessibility of the service for individuals with disabilities. If the product is compatible with voice recognition software, the offerors must provide a list of the software. Usage Reports: All offerors must detail how usage will be reported to OCR. The offerors must include the content of the reports, the frequency of the reports, and how OCR will receive the usage reports. In addition to the evaluation criteria listed under Vendor Selection Criteria, Past Performance will be evaluated. Offerors are requested to submit no more than five relevant projects. Such descriptions shall include the name and a description of the project, a brief description of the nature of the tasks performed by the proposed personnel on that project, the dates of the project, other relevant project data and the name and telephone number of a reference for that project. Each such project description shall not exceed two pages. ED requires an original and three hard copies of your quote. Your response to this RFQ, which shall reference EDOOCR-03-000027, must be submitted by 02:00 p.m., EST, on Monday March 10, 2003 to: U. S. Department of Education, OCFO CPO Group A, 7th and D Streets, SW, ROB-3 Room 3069, Washington, DC 20202-4444, Attn: Pamela Bone. All Quotes must be submitted in two separate volumes, cost proposal and technical proposal. The past performance information shall be included in the Cost proposal.
