- NA Sole Source Commercial Acquisition: This is notice of intent to negotiate on a sole source basis with Bruel & Kjaer North American, Inc., 2815A Colonnades Court, Norcross, GA 30071 for data logger upgrade equipment, software and warranty in support of auto motive testing at the United States Army Yuma Proving Ground (USAYPG), AZ. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within ten days after date of publication of this synops is will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered so lely for the purpose of determining whether to conduct a competitive procurement. Bruel & Kjaer is the only firm that can provide such interchangeable equipment for this upgrade, as they are the original equipment manufacturer and form, fit and function is essential with Bruel & Kjaer proprietary systems design rights of the original existing systems. This equipment is considered commercial in nature and award will be based on acquisition of commercial items under FAR Part 12 through FAR 2001-12 and DAC 91- 13. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals ar e being requested and a written solicitation will not be issued. If your company can provide the same listed equipment & software form, fit and function and data rights to existing equipment and software, facsimile or email your proposal description, inclu ding price, availability, contractor certifications under the commercial item contract terms herein, and whether or not you will accept payment by government Visa to Miss Winkler.
