Description
This is a combined synopsis/solicitation for commercial supply items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; PROPOSALS ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. The solicitation number is 6200001832 and the lot numbers are MT639-02 (items 1 through 7 for Leavenworth, KS) and MT638-02 (items 8 through 11 for Talladega, AL) and this solicitation is issued as a Request for Proposals that may result in the award of two three year Firm Fixed Price Requirements Type Contracts. The quantities listed in the solicitation are estimates only, and shall not obligate the Government. This acquisition is unrestricted. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-08. The Standard Industrial Classification code is 5031, the FPDS Product Code is 5510, the NAICS Code is 42131 and small business size standard is 500. This solicitation is for lumber that will be used for building furniture in UNICOR?s Dorm and Quarters furniture factories in Talladega, AL and Leavenworth, KS. NOTE: After receipt of initial proposals including pricing, all responsive and responsible offerors may participate in a FreeMarkets, Inc. reverse auction as a Competitive Bidding Event, CBE 7736 currently scheduled for October 17, 2002. This Bidding Event will be considered as discussions. The Government does have the right to award without the Competitive Bidding Event or discussions. The contractor will only deliver items and quantities specified by individual delivery orders placed by authorized personnel either at the specific factory location or by Contracting Officers at the Central Office in Washington D.C. Variations in quantity acceptable per each delivery order are plus 10 percent or minus zero 0 percent. SPECIAL PROVISION: 12 months after contract award date, and every 12 months thereafter, contract prices for items listed in the schedule under Section B, may be adjusted in accordance with the change in the Hardwood Market Report price list for applicable sizes and species. The base price at the time of award of contract may fluctuate upward or downward according with price adjustment proportionate increases or decreases as a result of the Hardwood Market survey. It is the contractor?s responsibility to request this upward or downward adjustment. Adjustment may be requested for a period of 60 calendar days after eligible adjustment date. Requests that are made after 60 days limit will not be honored and the contract pricing will remain unchanged; provided the adjustment is not a decrease. All downward price adjustments will be retroactive to the authorized adjustment date as specified in this clause. If the downward price adjustments are not requested and this is later revealed through audits or otherwise, the contractor shall reimburse the government and the amount overcharged plus interest. Interest will be computed at the rate set annually by the Secretary of the Treasury for late contract payment. Interest will be accrued from the date adjustment should have been made. The Contractor shall submit any request for adjustment in writing to the Contracting Officer. Request should include a copy of the relevant consumer price index and must be within the allowed time period for adjustment. The date the completed request is received by the Contracting Officer will be the effective date of any changes in price. In computing any contract price adjustment, a comparison of same or similar items being purchased will be compared with the market survey data collected by UNICOR, as of the date of adjustment. The total upward adjustment ceiling limitation for the duration of the contract is 15 percent. SPECIFICATIONS and QUANTITIES: Delivery shall be made in 14 days After Receipt of Order, FOB Destination to UNICOR, Federal Prison Industries, Inc.: 1300 Metropolitan Avenue, Leavenworth, Kansas, 66048; or 565 East Renfroe Road, Talladega, AL 35160. The COTR at Leavenworth shall be John Pugh, Quality Assurance Manager, 913-682-8700x363; and at Talladega shall be Larry Jefferson, 256-315-4191. Delivery Order Limitations for the lumber are as follows: For Marianna and Talladega the minimum amount per line item is $1000.00 and the minimum delivery order amount is $2000.00, the maximum amount per line item is $100,000 and the maximum amount per delivery order is $400,000. Provision at FAR 52.2121, Instructions to OffertoryCommercial applies to this acquisition. Offers are to include a completed copy of the provision at 52.2123, Offer or Representations and CertificationsCommercial Items, with their proposal. Clause 52.2122, EvaluationCommercial Items applies. FPI9999.9999, Business Management Questionnaire must be completed with 3-5 references for contracts that are of similar size and complexity. Clause 52.2125, Contract Terms and Conditions Required to Implement Statutes Or Executive OrdersCommercial Items applies. 52.2046, Contractor Identification Number Data Universal Numbering System (DUNS) applies. In accordance with FAR 52.21618 Ordering, the order may be issued under the resulting contract from the initial date of performance through three (3) years thereafter. OMB Clearance 9000-0136 Expires September 30, 2001. FAR 52.23234 Payment by Electronic Funds Transfer-Non-Central Contractor Registration applies. Vendors shall submit signed and dated proposals to UNICOR, Federal Prison Industries, 400 First St. N.W., 6th Floor, Washington D.C. 20534, tel. 202-305-7258, FAX 202-305-7353/54. Proposals should be submitted on the SF1449. Proposal and certifications may also be sent by facsimile to M. John Huotari, Contracting Officer. The date and time for receipt of proposals is Close of Business October 3, 2002. The proposal must indicate solicitation No. MT638-02 or MT639-02, time specified for receipt of offerors, name, address and telephone number of offeror, technical description of the item being offered in sufficient detail to evaluate compliance with the requirements in the solicitation, terms of any expressed warranty, price and any discount terms, remit to address, a completed copy of representations and certifications at FAR 52.2123, and acknowledgment of all amendments, if any. All proposals that fail to furnish required representations and certifications or information or reject the terms and conditions of the solicitation may be excluded from consideration. The Government may make award without discussions with offerors, therefore, the offerors initial proposal should contain offerors best pricing. Any amendments hereby issued to this solicitation shall be synopsized in the same manner as this solicitation and must be acknowledged by each offeror. Offeror must hold prices firm for 60 calendar days from the date specified for receipt of offers. Proposals or modifications to proposals received at the address specified for the receipt of proposals after the exact time specified may not be considered unless the Government issues an amendment opening the RFP for revisions. I. GENERAL The Contracting Officer has opted to conduct a competitive, anonymous, on-line reverse auction (auction) as described herein and in Attachment A. UNICOR has contracted with FreeMarkets, Inc. (FreeMarkets) for FreeMarkets to conduct the auction for this solicitation. FreeMarkets refers to such an auction as a Competitive Bidding Event (CBE). For the sake of consistency and to avoid confusion, this solicitation will similarly refer to such auction as a CBE. However, use of this phrase shall not be construed to imply that this solicitation is being conducted under the procedures set forth at FAR Part 14, Sealed Bidding. Rather, this solicitation is being conducted under the procedures set forth at FAR Part 12, Acquisition of Commercial Items, in conjunction with the policies and procedures for solicitation, evaluation, and award prescribed in FAR Part 15, Contracting by Negotiation. During the CBE, Offerors will provide pricing through submission of electronic offers via software that will be provided by FreeMarkets. The primary pricing competition for this solicitation will be through the online reverse auction. FreeMarkets will explain this process in detail and train each qualified offeror prior to the CBE. Offerors will have the ability to submit revised pricing during the CBE in response to prices submitted by other offerors. The identity of offerors will not be revealed to each other during the CBE. The final such revision during the CBE will be considered the Offeror?s final proposal. The Contracting Officer reserves the right to conduct verbal or written discussions with respect to factors other than price with the Offerors at anytime prior to award.
