- This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number N00140-02-Q-2672 is issued as a request for quotation (RFQ) using Simplified Acquisition Procedures under the test program for commercial items found at FAR 13.5. This solicitation documents and incorporates provisions and clauses in effect through FAC 08. The clauses may be accessed in full text at this address: www.arnet.gov/far. The FISC Detachment Philadelphia requests responses from qualified sources capable of providing the following Contract Line Item Numbers (CLINs): CLIN 0001, with optional CLINs 0005, 0009, 0013, and 0017 for four one-year periods subsequent to the base period of 1 OCT 2002 through 30 SEP 2003: Subscription Services for Legal Research Databases at FISC Norfolk Detachment Philadelphia in accordance with the Statement of Work for six users for a quantity of 12 and a unit of measure of months. CLIN 0002, with optional CLINs 0006, 0010, 0014, and 0018 for four one-year periods subsequent to the base period of 1 OCT 2002 through 30 SEP 2003: Subscription Services for Legal Research Databases at NAVICP Philadelphia in accordance with the Statement of Work for ten users for a quantity of 12 and a unit of measure of months. CLIN 0003, with optional CLINs 0007, 0011, 0015, and 0019 for four one-year periods subsequent to the base period of 1 OCT 2002 through 30 SEP 2003: Subscription Services for Legal Research Databases at NAVICP Mechanicsburg in accordance with the Statement of Work for seven users for a quantity of 12 and a unit of measure of months. CLIN 0004, with optional CLINs 0008, 0012, 0016, and 0020 for four one-year periods subsequent to the base period of 1 OCT 2002 through 30 SEP 2003: Subscription Services for Legal Research Databases at NAVSUP Headquarters in accordance with the Statement of Work for seven users for a quantity of 12 and a unit of measure of months. STATEMENT OF WORK: Contractor shall provide a web-based subscription service allowing NAVSUP Offices of Counsel access to a comprehensive legal research database. These services shall be provided at a fixed monthly rate for a period of 1 year with 4 one-year options. At a minimum, the information that must be accessible on these commercially available legal research databases shall include: Government Contracts Law materials; Administrative Law materials; Federal cases, statutes, and regulations; State cases, statutes, and regulations; Law Journals and periodicals; and Federal Sector personnel cases. The following FAR provision and clauses are applicable to this procurement: The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. Addenda to the provision: (a) NAICS: 514191 Small Business Size Standard: $18M (b) (4) A technical description of the items being offered, in sufficient detail to evaluate compliance with the requirements in the solicitation, including identification of anything offered in addition to the Government?s minimum requirement that would be available within the quoted monthly price. This may include product literature, or other documents, if necessary. The technical capability shall include what training and technical support is either 1) available at the unit price OR 2) available at an additional price with the price provided. (6) Price and any discount terms. If you offer a price break based on step ladder or higher quantities, provide this information in the quote, in addition to the unit prices for each CLIN. Be sure to include any pricing information required for training and technical support. (10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and (12) If an offeror submits a proposal which is considered to be in excess of the Government?s minimum requirements, the contractor must detail the excesses and explain why they are beneficial to the Navy. (e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately. (g) Contract award. The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received. The provision at 52.212-2, Evaluation -- Commercial Items is applicable. Evaluation criteria are as follows: Past Performance, Technical capability to meet Government?s minimum requirement, and Price. Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer. (Can be accessed at http://farsite.hill.af.mil) The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition. Addendum to paragraph (i) of the clause: Payment using the Government Purchase Card is authorized, as per FAR Clause 52.232-36, ?PAYMENT BY THIRD PARTY? MAY 1999. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items, applies to this acquisition. In addition, the following clauses are applicable from paragraph (b) of the clause: 3, 12, 13, 14, 26. This procurement is assigned a DO rating under the Defense Priorities and Allocations System (DPAS).
