- The U.S. Minerals Management Service, under its Royalty in Kind program, is chartered to sell the Government's royalty share of certain oil and natural gas assets produced on lands of the United States in a manner consistent with established industry practice. From time to time it is advantageous to transport the product to market centers or to process natural gas prior to offering it for sale. No funds appropriated by Congress are available for this purpose, but Public Law 106-291 permits the use of revenues under the Royalty in Kind program to pay for these services. This posting will serve as notice of the intent and methodology to enter into such agreements. When analysis shows that transportation or processing agreements would be advantageous to the Government, the Minerals Management Service will conduct market research to identify potential sources. When more than one potential source is identified the Minerals Management Service will seek competitive offers from capable sources. In many instances, only one source for the services will be available, e.g. when only one pipeline exists for transport, or when only one processing plant is within the transport stream. In those cases the Minerals Management Service will negotiate favorable prices and terms with the single source. Since the Royalty in Kind program is expected to embrace established commercial practices, the Minerals Management Service intends to use contract practice and formats common to the industry. No public announcements will be made for individual actions since it is expected that staff research and knowledge of the industry will identify all reasonably available sources.
