Description
In August 1998 the U.S. Patent and Trademark Office (USPTO) competitively awarded through the GSA FSS Blanket Purchase Agreement (BPA) to Software Performance Systems (SPS) for software development and maintenance support using Gentia software. SPS has developed, enhanced, and maintained the Patent Operational Planning and Budget Administration System (OPBUDGET) to the present and has provided on-going support to facilitate the USPTO's initiatives of reducing patent pendency and enhancing the quality of patent examinations. The USPTO subsequently awarded an eleven (11) month sole source BPA to SPS beginning in October 2001 to continue support of the USPTO's mission critical decision support system OPBUDGET. The USPTO now intends to negotiate on a sole source basis with SPS a cost plus fixed fee contract for the acquisition of continued developmental support and enhancements using the Gentia software and database development environment. The period of performance will be for eighteen (18) months with an expected start on April 1, 2002 and continuing through September 30, 2003. During the 18-month time frame the USPTO intends to transition from the Gentia software and database development environment to a new state-of-the-art environment for OPBUDGET. This transition will be accomplished with other contractors developing and later enhancing and maintaining the new state-of-the-art environment for OPBUDGET. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Unacceptable cost, schedule, and technical risks would be incurred if another contractor were selected for the OPBUDGET effort. Awarding these services to any other source would result in a cost duplication the USPTO is not in a financial position to bear, jeopardize large investments the USPTO has made in developing OPBUDGET, and result in unacceptable delays. This is NOT a request for proposals, nor will one be made available. However, concerns that respond must furnish detailed information describing capabilities to deliver the above services to: U.S. Patent and Trademark Office, Office of Procurement, Box 6, Washington, DC 20231.
