Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 of the Federal Acquisition Regulations (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; and a written solicitation will not be issued. The Solicitation Number 5000004862 is issued as a Request for Proposals (RFP). UNICOR, Federal Prison Industries intends to negotiate and award a sole source contract, to Estherlee Fence Co., North Lima, Ohio. Pursuant to FAR 6.302-2, Unusual and Compelling Urgency. The proposed vendor will provide the installation of an Exterior Security Fence at the Federal Correctional Institution at Elkton, Ohio. The basis for the proposed non-competitive action is that this is an unusual and compelling urgency for perimeter security. The period of performance is 15 days after award of contract. The small business size standard is 500 and the Standard Industrial Classification Code is 3496. UNICOR, Federal Prison Industries, Inc. intends to enter into a Firm Fixed Price, Requirements type contract. The requirement: Installation of an Exterior Security Fence: Line Item 0001 - Set Posts Only, Core Drill and Set in Dirt, Material, Labor and Equipment. Estimate Quantity: 1 Job. Line Item 0002 - Installation of Fence and Gates, Material, Labor and Equipment. Estimate Quantity: 1 Job. Delivery is FOB Destination to UNICOR, Federal Prison Industries, Federal Correctional Institution, Elkton, OH 44415. The Contracting Officers Technical Representative (COTR) is Kevin Shaffer (330) 424-7448. This procurement is a sole source and the intent of this synopsis is for informational purposes only, and is not a request for competitive bids; no solicitation will be issued. The following clauses also apply to this solicitation: FAR 52.212-1 Instructions To Offerors -- Commercial Items; 52.212-3 Offerors Representations and Certifications--Commercial Items. FAR 52.212-4 Contract Terms and Conditions -- Commercial Items, FAR 52.212-5 Contract Terms and Conditions Required To Implement Statutes Or Executive Orders--Commercial Items Instructions to Offerors. All required forms are available at http://www.unicor.gov/procurement and clicking on the "Procurement Forms" link. Offerors must submit the following forms: 1.) ACH Vendor/Miscellaneous Payment Enrollment Form; 2.) FP19999.999-9,Business Management Questionnaire; 3.) SF1449- Solicitation/Contract/Order for Commercial Items. Drawings will be attached to solicitation on UNICOR's web page. (See below for UNICOR's web page address.) Proposals that reject the terms and conditions of this announcement or do not include all of the required forms may be excluded from consideration. The solicitation document and incorporated clauses and provisions are those in effect through Federal Acquisition Circular 2001-01. Offerors may submit signed and dated Federal Express or hand delivered offers to UNICOR, Federal Prison Industries, Inc., Material Management Branch, 400 First Street NW, Washington, DC 20534, 7th Floor, Attn: Rhonda Robinson. The due date and time for receipt of proposal is February 19, 2002 at 3:00 p.m. EST. Facsimile Proposals to (202) 305-7365. Each proposal must contain the name, address and telephone number of the offeror as well as any discount terms that are offered. Offeror must hold their prices firm for 30 calendar days from the due date specified for receipt of proposals. Incremental pricing will not be accepted. Any amendments hereby issued to this solicitation will be synopsized in the same manner as this solicitation and must be acknowledged by each offeror. Any proposals or modifications to proposals received after the specified due date for receipt of proposals will not be considered. In accordance with FAR 52.212-2 Evaluation--Commercial Items, evaluation of offers will be based on price and price related factors. Discounts for early payment, if offered, will not be considered in the price evaluation. The Government intends to evaluate the proposal and award a contract without discussion on an all or none basis to the responsible offeror whose proposal conforms to the solicitation and will be most advantageous to the Government, considering price and price related factors, past performance and specifications criteria listed. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The following factors shall be used to evaluate offers: The award decision will be based on evaluation factors, such as (i) price and price related factors; (ii) technical capability of the item offered to meet the Government requirement; (iii) past performance. All evaluation factors other than cost or price, when combined, are significantly less important than cost or price. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offers specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. In accordance with FAR 52.216-21 Requirements, the contractor shall not be obligated to make deliveries under this contract after 15 days beyond the contract expiration date. Office of Management and Budget (OMB) No. 9000-0136 applies to this Solicitation under the Paperwork Reduction Act. FAR 52.211-2, Availability of Spec.
